I am a citizen of the United Kingdom, I am currently visiting California under the 90 Visa Wavier program. I have been offered a job in an IT company and they wish to sponsor me,they have recently lost 2 employees and are looking to employ 4 people in total and are desperate since losing 2 employees.

I have 7 years of IT experience but no degrees of any kind, only High School equiverlent education.

I am wanted by the company on a permanent basis but they are happy to employ me on a temporary visa and have it made permenent at a later date.

Being in the country on a 90 Day waiver is there any possible way this can be extended or apply for Change Of Status? Or will I HAVE to return to the UK and apply at the Consulate?

Hi Andy, I do not have the answer to your question, but here is a number for the National Customer Service Center 1-800-375-5283. They should be able to answer your question for sure. Good luck.

Those here on a the VWP cannot extend or change their status (ie. file I-539). However they may adjust (I-485). If your employer is able to get the paperwork in for I-140 to file for a permanent residence for you before your I-94 (and in conjunction with the I-184) then you are ok. However, with the DOL process I doubt you will get all the paperwork before your I-94 expires so you better go back to your country and wait for the appropriate visa.
