After LC is approved, if the sponsor company is financially stable, and the process would continue to I-140 up to AOS, is visa available now? This is using priority date 2/02 or 4/01. Or one should still wait for visa availability? And for how long, is it 4 to 5 years also? Hope to hear from someone. Thanks,
Hi Dondie ! The date labor certificate is first filed with Department of labor would be your priority date. How come you have two priority dates ? Which country are u from ? Did you apply for EB-2 or EB-3 ???
Hi Rida. I have 2 priority dates because the 4/01 is the original application, then reapplied for RIR on 2/02. I don't really understand this but I just followed them (employer).

Rida. I think it was EB-2 that they applied for me. Being H1B is one EB-2? Looking at the processing times, it says 03/01 for EB2. I have another question, which one is my priority date now 4/01 or 2/04? The last paperwork I got from DOL says my priority is 4/01, so is that it? Thanks.
heh, which part of "need of country of origin" question you don't understand?
H1-B doesn't equate EB2. Besides, there're no such thing as 03/01 priority date for EB2 in the current bulletin.
As for priority date, it'll depend in which one is approved, the RIR or Non-RIR. I would think they withdrew the old application when they file for RIR, since its for the same position anyway isn't it? If thats the case your priority date is 02/02. If thats not the case and the Non-RIR got approved, then your priority date is 04/01.
