I just asked a question what would happen its not about following the law or not and besides going to the us border with an expired re-entry permit does not break the law.I guess you need to refer to the Laws of the US.

Your case I think is under this SEC. 223[8 U.S.C.](c) During the period of validity, such permit may be used by the alien in making one or more applications for reentry into the United States.
(d) Upon the return of the alien to the United States the permit shall be presented to the immigration officer at the port of entry, and upon the expiration of its validity, the permit shall be surrendered to the Service.
(e) A permit issued under this section in the possession of the person to whom issued, shall be accepted in lieu of any visa which otherwise would be required from such person under this Act. Otherwise a permit issued under this section shall have no effect under the immigration laws except to show that the alien to whom it was issued is returning from a temporary visit abroad; but nothing in this section shall be construed as making such permit the exclusive means of establishing that the alien is so returning.
Since 1998 any Permit to Re-Enter the United States is issued to an Alien Permit # A ... will be the same # as his Green Card #.
Most of the POE had all the equipments to check the arrival and departure of the Alien.

1- You received your DV visa and arrived in, month of 1999 when you was 12 years.
You got your Green Card in month of 1999.
First visit: Same year (1999) you traveled abroad for how long?
Second Visit(1999) how long?
First permit Expired in 2001(two years)
Third visit 2002, obtained 2nd Re-Entry Permit
This must have expired in 2004.
You had long time to use and keep up with your residency which you have abandoned.
The law is blind and will not accept any excuse in your case.
Sorry about your brother, but laws in any country will not look into that fact.
I am sure that that you will have to stay in Canada until you get another visa to get back into the United States.

Why don't you call and find out from the US Embassy, in Canada they should provide you with all the info you need.

Thanks adam for being so kind and explaining everything i really appreciate what you did.I better check with the US embassy in Canada but i am not sure if they offer the returning resident visa (SB-1) visa or maybe it would be a good idea to apply for it from the us embassy in my home country maybe they would be more generous and considerate.

In regards to your SB-1, you will have to proof it to the Consular Officer, with evidence that was beyond your control to return in time. I am sure you might have some thing to proof your delay in not returning to US.

Hey adam both my parents have brothers and sisters who are citizens in the US and we have numerous relatives too.Do u think if my whole family surrenders the green cards now they can immigrate again(i-130) and we could start the procedure again.How much time does it take for the i-130 petition form to be approved and a person getting the green cards again????.Do you think it is worth more and has more chances of success than applying for sb-1 and trying to obtain your status back???And one more question when our parents get the green cards through their siblings do we get it too??

You said that all of you got the Immigration visa through DV 1999, and at one place you said that your mother is n Legal Permanent Residence.
Are they still the LPR or they all loss the status, It sounds like your family is back at home.
Why you want to surrender the Green Card?

Please explain correctly all the facts about the family, and Status, then we can suggecst you what you can do>.

no my mom is not in the us.all of them r back home in dubai and i did get my green card through the dv in 1999.so now regarding my situation what do you advise? and my whole situation is described in my 1st post of this forum.

when u r in dubai they ask u to leave after u turn 18(only for men) and they dont renew your visa.so thats y u leave dubai.hey adam u havent replied yet??

So...people actually leave Dubai when their visas expire? What a novel idea!!

America needs to follow Dubai's example because they're obviously doing something right.

I guess that the Dubai authorities don't pay any attention to the bellyaching of those who they demand leave the country...and, obviously, they leave!! Let the Dubai immigration authority train USCIS!!

They probably would have paid attention if they had some oranges that needed to be picked.

No sunny devil man dubai has these policies that u can live and work in uae until u have the residence visa(that u get if u have a job or u r living wid your parents) .After you turn 18 u can go to university there and get your student residence visa then or if u get a professional job like an engineer etc ..... u can get the visa.u lose your visa if u stay out of uae for 6 months.

Hey but sun devil there r problems because dubai is soo good ppl have their visas expired and never leave dubai ever again so then they cant go to any other country ever.they live there whole life in dubai then Eek

If that was the case, your butt would be back in that god forsaken country of your ancestors. YOu would have a better chance winning an internet lottery scam. Think about that one if your cranial cavity has anything in there besides mildew.

Sorry CoolRaz, but all the answers are also in the first few posts.

You've abandoned your status of permanent resident in the US. The little I know about SB-1 visas, you don't qualify for it (or at least you did not tell us a reason, for not returning to the US, that would be beyond your control, like serious sickness).
