Thanks for making it clear...because I know some dmv's here do not know s.h.i.t. cause they think,as long as u are not a US Citizen,you will get a non renewable license.

thanks for the law code as well...

I agree with Hudson, you need proof of residency when you apply or renew for D/l. I've been on a H-1 visa since 2000 and living in NJ. Had to renew my D/L last month. In NJ you need to bring your passport w/ current valid US visa and 2 documents to prove your address and name as per your D/l. If you had a name change (due to marriage, divorce etc) you also have to bring the original document showing the name change. They will also run your SSN to make sure it's valid. If your cousin has any original documentation from the Immigration to show her petition is pending the DMV will accept it.

yeah,its amazing that there are so many states out there where u do not even have to proof if u are legal here or anything...
not to mention to show proof of your current address.

I mean here in Ohio u have to proof u are legally here...but each time i had to update my address,i did nnot have to show proof,i mean i could have given any address that popped in my mind.

I have a question...is anyone here living in Texas?????? if so,do you get your drivers license there at the dmv on the spot after they haven taken your picture for the drivers license?

I know in some states u have to wait couple weeks and they mail it to you...like in Tennesee or California...anyone about texas?

There is a difference between being a resident of a state and being a US citizen or resident, HK. This concept has to do with the US definition of "federalism." States and municipalities are not extensions of the US government. They never have nor will they ever be. However, states and municipalities must confer with the US Constitution. US states and municipalities can be more restrictive of the US constitution, but not too broad.

Maryland now required proof of legal status when you are trying to request D/L. I just recently received my MD D/L. I have out of state license.
MD DMV runs a Homeland security check on me, required me to provide any legal status, 2 proofs of residency, social security.

1. Regulations at local DMV's may change anytime.

2. Under REAL ID Act ALL States must comply with Federal (six point ID) requirement before issuing DL to anyone (deadline , I believe, is 2008).
Some States still consider ways to opt out.


3.DMV does not run "security" check, but in some states it does verufy the applicant's immigration papers with DHS.

yes it does on me...reason my NC lic is dicapitated! LOL

whatever too i am just telling what i been through and told by the MVA. There is a stack of paper with my info, addresses last couple years and such....how's that verify my immigrantion
