see that's exactly what I am talking about! you are such of an idiot!! My last name doesn't have anything to do with INS, but they must know my married last name...
You would need to let them know about the name change obviously. Being married may not affect anything until you actually try to change status. What you may want to do is contact the consular in your home country for input as to what the time frames are and such for these type cases now so you will have an idea of what to expect and if there are any other issues specific to your case you may need to attend to.
Vote Republican and this country will still be worth sneaking into.

Sending in the I-130 may trigger the chain of events to cause deportation. The I-130 is filed for persons who are eligible for a visa. Since you were EWI you would not be.
What ends up happening is you revert to what you were before TPS. If you were here for less than 6 months then it won't be too bad since no ban would be incurred. The time of unlawful presence is determined by the documentation at the time TPS status was given. You would have been asked when you arrived in this country. That is a key date to determine if you are subject to a 3 or 10 yr ban. At minnimum the clock starts on that date and ends on the date you applied for TPS.
Something else to look at is called 'Deferred Departure' or 'Deferred Enforced Departure'. These are two common forms of relief from deportation that is administered through the the Attorney general. These would come into play when the I-130 is denied.
In the end you will need to go through the process of returning home and going through consular processing in order to have legal status.

esta pendeja debe salir de mi pais nativo. You are a border jumping cheat....the US of A does not owe you anything....you started your occupation of my country in an illegal fashion, believing that our laws don't apply to you...but you jumped at the chance for TPS, thus showing your hypocritical compliance with our rules....and now, facing the boot (and good riddance) you whine and whine and whine about those "unfair laws"...too bad....you should have obeyed our laws from the start.

Yeah right now you know the only way to stay in this country is perpetrate another fraud and marry a USC and then screw him over once you get your greencard. Fantastic Strategy but nothing new.

Why do you automatically assume everyone is from Mexico, SunDevil? Sounds like a sick obsession to me. You are not anti-illegal; you are anti-Mexican which makes you a racist.

You may not be able to adjust status from within the USA, as an EWI. Normally an alien that is EWI is required to depart the country and be legally admitted so that adjustment of status in the USA could occur. Of course, dependent upon how long you have been in the country without lawful presence, this departure could trigger a lengthy bar to admission.
However, since you are now married to a US citizen, it might be possible for the US citizen to file a waiver to permit readmission, despite a bar, IF your case will qualify. The issue would be to determine IF your US citizen spouse would suffer severe hardship from your being barred from re-entering the USA.
Your first course of action would be to query a qualified immigration attorney that works with waivers for inadmissibility.
