Entered USA without inspection back in 1996; I am under Nicaraguan-TPS since 1998. I just got married, I can proudly say my marriage is based on pure love. He is an USA citizen. According to my lawyer I cannot readjust status because I entered without inspection. She suggested us to file i-130 Petition for Alien Relative. She said that i-130 may not make a difference in a short term, but it could save me from being deported in the future. Although I am able to work and pay taxes as anybody else, own property, educated, no criminal background. I don't qualify for readjustment. I am afraid that one day INS will say: "Bye-Bye now!" I have to live expecting a work permit every one year half... of course paying their fee, and I cannot even leave the country - NOT allow to re-enter USA. How about if I have children, and they decide - it's time to go?

How were you able to adjust your status to TPS after entering without inspection? I'm not sure your lawyer is correct on his advice. If your current status is TPS, it is much different than still being EWI. Did you go through a process to qualify for TPS?
I was born in Nicaragua, and USA granted TPS for any Nicaraguan citizen that entered USA before 97, I have been under TPS since 1998, I re-register every year 1/2. The process was very simply; i-821 + i-765, and proof of my origin.
YES! My status is TPS, but I DID enter without inspection from Mexico for that specific reason I am not allow to readjust... They are punishing me for entering without inspection... PAY BACK TIME! Although I am married to an USA citizen, it doesn't make a difference
JSalas is correct - the granting of Temporary Protected Status (TPS) doesn't overcome the fact that she entered America illegally in the first place. In order to obtain permanent residency, she will be required to return to her country of origin for processing.
As a matter of routine, the application for residency will be denied...because of the illegal entry...and her U.S. citizen spouse will apply for a waiver.

Well, what exactly did you expect when you entered America illegally?
I expect to at least be able to leave USA and be able to re-enter; Be aware that I pay taxes as everybody else; I have a CLEAN criminal background. I hold an Accounting degree, but don't qualify for students loans. I own property - but don't qualify for homestead exemption. SO here it's someone that made her way thru and accomplished more than probably someone that was born here. I have so much to offer to society. You don't have a lot of choices when you need to make your life better, I didn't EWI for fun. I needed to make my life better and DID SO. INS should hold back people that haven't done anything for themselves. And should NOT put aside educated and hard working people like myself. The sould be able to identify good and bad immigrants...

According to the regs if you drop TPS you will revert back to your prior status, EWI. Which means that once the I-130 gets filed and approved you'll be asked to leave and return to your home country in order to adjust status. TPS drops automatically once another status is sought.
Depending on other factors such as how long you were here prior to TPS will also affect your process. You may incur a ban of 3 or 10 years if your presence was documented here for over 6 months or over 1 year prior to TPS. In order to overcome that ban a i-601 'extreme hardship' waiver will need to be filed. The hardship is based on your absence to the USC spouse, not the intending immigrant.
In so far as travel is concerned you should contact the local USCIS office for travel documents. With respect to the comments about paying taxes and such. Anyone coming here, with or without a visa is expected to. Those are separate laws and jurisdictions covered by the US Treasury and Internal Revenue Service. Failure to pay taxes would bring about more violations. Your an accountant you know that.
The reason the marriage etc is irrelevant is that those conditions , circumstances, and events that occurred afterwards would not have if the first criminal act didn't. With that those events can not be used as a defense for the first act.
Vote Republican and this country will still be worth sneaking into.
