My friend married a US citizen, she left last December 2007 and no where to be found, his application for adjustment of status was denied but no letter coming from INS that it was denied, we only saw it on the case status search on the INS website.
My friend ask help from attorney last March 12, 2008, he paid $2,000 to see what is going on. On the website case status, it says "On February 12, 2008 INS sent a letter of denial to the adjustment of status and if in case the person did not get any mail from INS about the denial he must call the 1-800 number".
Since March, the Attorney never call or sent any letter what is happening on my friends case.
Last week my friend call the attorney and ask the Attorney said that do not worry he is doing all he can and said that he do not have to follow up the denial as my friend did not not receive any letter from INS. Attorney said just wait.
My friend is afraid now cause she do not have any visa anymore and his working authorization will expired.
IS the Attorney telling the truth to wait and see what the INS will do to his denial. I told my friend to call the 1-800 and tell INS that he did not get any denial letter.
HELP my friend please.

wow there we go with another clown attorney, if the i-485 was denied then your friend is an illegal alien ,and uscis mail gets lost all the times but the only way to prove them wrong and to fight them is what my friend? to appeal it and this clown is telling him to wait, they will deport him if he gets caught at this stage, tell him to go to the attorney's office and get his file back from him and to call the bar of association and file a complaint,he needs a better attorney ,this guy is a joke. if he didn't appeal then what is he expecting to hear from uscis? this guy is a joke

Perhaps having them re-send the denial letter to his current address would help explain why.

I'm guessing they split up and he was the one who moved out. If he didn't do a follow up with USCIS with a change of address he would never have received the letter.

If the denial was due to her retracting her sponsorship there isn't much he can do. No sponsor, no immigration.

She wants my friend to move where the kids move, but my friend got a job here and he just cannot move anywhere with papers still on processing. Then suddenly the wife did not come home anymore and she said to him she will file a divorce. She move out December 2007 and on the search records at INS website said that they sent the notification of denial of adjustment of status on February 12, 2008. Unfortunately my friend did not get any letter. The Attorney who is handling the case at that time did not follow up the notices that we saw on the website and he saw too but instead transfer the case to another attorney who said to wait till the INS make a move. And they will tell the INS he did not get any letter.
One more thing my friend is a tourist here who met this girl and live together and get married after the girl divorce his first husband. As of now he is Ok but no Visa anymore and his EAD will expire this August 2008.
Help....

You are kidding, the wife is alive and well and kicking as we saw her one month ago. She is working on one of the best hospital here in downtown and another friend of mine work with her.
Be positive please, I am asking help here for a friend and not a joke.

Yes she sign the I-485 and the papers is in order but it was denied. I am asking my friend to ask the INS to resend the denial letter and lets see what it says. But he said it is the Attorneys job to get the denial letter. Problem is the Attorney is not doing anything and also the Attorney said she will find the girl and ask what is going on. But nothing is happening if he talks to the girl or the wife. It is now 4 months since the Attorney was paid $2,000 and nothing is happening to the case. My friend call the Attorney last week and said to the Attorney his EAD will expire and he said they will renew it. How long will it take for EAD to be renew?

More than likely she reconciled with her x-husband. After all, they do have kids together. It is best for their children to have the real parents taking care of them.

She probably revoked the immigration sponsorship to eliminate the liability and may have already filed for divorce. Assuming that is the case your friend should just leave them alone and go home.

Without the visa the employment authorization is no longer valid. At this juncture your friend is an illegal. He should probably be careful. Since the women had the smarts to revoke sponsorship she may be aware of his actual status. If she is then a call to DOH will result in him being picked up and shipped home by force. He should leave before 180 days have lapsed since the visa cancellation. Otherwise he will be subject to a 3 year ban from re-entry.

Yup, no where to be found after she left the house last December up to June and she went on hiding to get rid of my friend. We just knew that she is working at a big hospital in downtown and when we approach her she said she is applying for a divo and divorcing my friend. That is why my friend look for an Attorney for help after three months of search. And one more thing I am not a liar, ask more question first before you find me guilty. IDIOT. Your not supposed to be here on this forum. Seems your a **** and your not helping, get out of my way and let other help me.

what was your friend status before he married the USC?

As of the denial of I-485 your friend's EAD is invalid ( she's now out of status).

If she/he doesn't have a sponsor, not much he can do for his case.

My friend is a tourist here who met this girl and live together and get married after the girl divorce his first husband. As of now he is Ok but no Visa anymore and his EAD will expire this August 2008.

Before this marriage happen, My friends wants to go home and let her US Citizen GF before and wife now to file a fiancee, but the Wife now that it will take a long time to wait so why not married here and then file. Well things go wrong because of the first husband and kids. As of now the US wife is not filing any divorce yet as she do not have money as she said.

Yup your missing something, we did not know because the letter from the INS did not reach my friend. INS said they sent the denial letter way back in February 12, 2008 but my friend did not receive anything.
Here is some part of story:

I already told you the deal, so did speed. Listen. Your friend is an illegal at the moment. The EAD is dead in the water without a valid AOS or visa. The reason for denial is obvious. The girl went back to her first husband, as she should have. She withdrew the sponsorship. An easy thing to do prior to approval.

I bet your friend was instrumental in breaking up their marriage to being with. What goes around comes around.

I already told that to my friend that he is already a TNT after the Visa expired and when the AOS is denied but the Attorney said he has all the chance to stay here and just wait. Also the Attorney said he will extend he's EAD before it expired.
The question from the beginning is:
1.) Is the Attorney telling the Truth to wait because the INS should make the first move because my friend did not get the denial letter?
2.) Is the Attorney can get his EAD renew?
3.) Is the Attorney doing anything without giving proof to my friend, only says wait and do not hurry?
My friend is getting afraid and said they are the Attorney they know what they are doing?

The Attorney already get paid $2,000 from the first day he was approach.
Help my friend what to do and give him a good advice about his Attorney.
