Pregnancy doesn't excuse your fiance's illegal presence. When she goes out of the US to wait for the visa, naturally so does the baby. Once the baby is already outside the US, the immigration has no further interest. USCIS does not care about the fact that your fiance has no access to health insurance.
Your separation with the baby does not add to your hardship because you always have an access to see your baby, and you even have an option to move to Indonesia. USCIS already knows many illegals intentionally get pregnant to try to use it as hardship, and they do not care for that.
Usually, hardship based on babies comes into play only when babies are several years old and have been living with you for a long time. In this case, USCIS could determine that babies are too old to be able to ajdust to a life in a 3rd world contry. This obviously does not apply to infants.

MajMike, the waivers are approved as a favour to USC when it is proved that USC would suffer an extreme hardship if the alien is not let back to the US. USCIS is not interested if and how an alien would suffer (lack of medical etc).
The child would be a USC and could reside in the US.
Just wondering how an Indonesian whent through a PoE without being inspected, the only thing that comes to mind is claiming to be a USC, which would raise a whole another issue.
How the loss of my unborn child would not be a cause of great harm to me I do not know, especially to a place where my child cannot receive decent healthcare (including prenatal). My shrink would be able to confirm that my mental health is such that such a seperation could lead to thoughts of suicide on my part(I'm better now, but I just came out of a major depression and she and the thoughts of my new baby had a big part in my recovery).

I wasn't there so I only have what I've been told. We're going to talk details this week so maybe I'll have a better grasp on exactly how she crossed. The basic story is that she was sleeping when they car she was in crossed, apparently without being checked at all. Her Indonesian passport has a Canadian Visa (6 mth visitor) about 4 years old, but nothing showing entry to the US. I will see it tomorrow.

I know how this may look to some, but I had to pursue this woman and our relationship progressed slowly. I am retired military, so I know how some folks will screw their way into a green card. I just don't see that in this woman, and our relationship is not like those I saw.
The bottom line is that I really do love her, we just want to do what is right and still be able to be together.

The immigration law is neither based on common sense nor sympathy for people. Otherwise, it would be ripe for discrimination. If it was, how do we choose who gets our sympathy and who doesn't.
Waiver process is a special previlege, not a given right. You can argue but at the end of the day, immigration officer will decide based on laws.

The whole story is bizarre and makes no sense at all. His fiance, as a citizen of Indonesia without a proper visa, would certainly have been denied the entry to US at the border.
4 years ago was when she came in, and that is after 9/11 terrorist attack. As a result, we all know the border security became very tight. Is it possible for a foriegner (from a muslim country no less) fall asleep in the back of a car and not get inspected? I might have just believed her story before 9/11, but it has to be impossible since then. To top it all, she never went back to Canada and instead, started working in US. Why did she get a job if it was meant to be a short visit? How was it that she was able to get a job, while being illegal? Under the table deal?
I think there has to be only one explanation to all this. When something is too incredle to be true, the simplest exlanation is usually the real truth - MajMikeW is being lied to by his fiance about her status. He needs to get the real truth from his fiance.
