Hello, I have just a few quick questions..

I live in Texas and I want to marry my fiance in December. He is out of status since his visa expired in 2002. He came here legally with inspection. He is 20. He has a valid passport, can he marry me with just a passport? He is from El Salvador and I am a USC.

Can he adjust his status after we marry? He is working with fake papers and I am so worried something bad will happen. I have been told him working will be forgiven. What is going to happen next as far as starting the adjustment of status process? Thank you and any advice will be helpful. I am so scared he will be deported!!!!

Hi Sweetiejujy,

It is true that your boyfriend's overstay and unauthorised work will be "forgiven" after two of you get married and AOS is approved.

However, there may be serious consenquences if the papers he is using for work belong to a real person (SSN number ?!). Do you know how he obtained the fake papers? Bought or made up a number?

Since your fiancé came here legally and you're a US citizen then he can adjust his status here. He won't be deported if he has never committed any crime here.

Marriage laws vary State to State. However, valid foreign passport is more than enough for him to get marriage license in almost every State in US.

Though his overstaying and working without INS permission would automatically be forgiven because he would be an immediate relative of US citizen (you) for immigration benefit, but working with fake documents is not one of them. If ever INS would find out that he used fake documents then he would be prosecuted like any other person. Using fake documents is a crime, a felony. No need to say that if he would ever get convicted on this crime then he would loose his chance of obtaining US residency. That's why it is very important not to tell about this to anyone and he should try to adjust his status as soon as possible.

Believe it or not, the options that are open to you and your fiance are the same as they were when you first posted this query many months ago.

The fact this she has to ask the same question because she cannot understand the answer only demonstrates the looooowwww level of intelligence these kind of women have who marry illegals....it is because they cannot find anyone else desperate enough - if you added up the IQ of all the women who marry illegal aliens, it might just break into 3 digits....maybe. Certainly their combined common sense factor is somewhere around zero. And can you imagine what they look like?
