359 suspected illegal migrants held in operation

SAN DIEGO -- U.S. authorities arrested 359 suspected illegal immigrants during a two-week operation in the San Diego area that ended Tuesday.

Fifty of those arrested had criminal records, including past convictions for child *** offenses, robbery, and drug violations, according to U.S. Immigration and Customs Enforcement.



Most were Mexican but the suspects were from 15 countries, including Cambodia, Cuba, Israel, Laos and Thailand. They were either returned to their countries or held in jail to wait for an appearance before an immigration judge.

The arrests were part of Operation Return to Sender, which has resulted in more than 18,000 arrests nationwide since it was launched last year. The campaign targets illegal immigrants with criminal records and those who have ignored deportation orders.

"Our message is if you are ordered deported, you should obey the immigration court's order," said Robin Baker, ICE field director for detention and removal in San Diego. "Otherwise, ICE is going to track you down and send you home."

The arrests nearly all occurred at homes, authorities said. Only 62 of the 359 arrested were targets in the operation. The rest were nearby when agents appeared, known as "collateral arrests."

Critics said the operation created a climate of fear.

"They're trying to sell it as something where they target (criminals) but it's become part of a larger dragnet," said Pedro Rios, director of the American Friends Service Committee's San Diego office. "It's not effective, and it's not a good way to do enforcement."

The arrests come amid signs of heightened immigration enforcement away from U.S. borders. A raid at a leather factory in New Bedford, Mass., last month resulted in the arrest of 361 workers suspected of being illegal immigrants. Nearly 70 people were arrested last week during an immigration raid at a temporary employment agency in Maryland.

I don't know if I fully agree. The situation would be different, yes, but would it be better?

Need, despair and hardship are not controllable by law or by any enforcement policy. People cross everyday regardless of potential penalties and knowing that they will be removed; criminal penalties alone are poor mechanisms to stop crime and that's a well known fact extensively described and commented during criminal hearings and policy-making sessions.

The main problem is the law itself, poorly constructed sometimes without logic. The problem still remains today.

Look at the STRIVE Act of 2007. One of the main objectives is to legalize workers, bring them out of the shadows, a goal clearly stated by the President. The new Act is an bipartisan effort, something supposed to be carefully constructed, but here's how it really works:

1. Immigrant must establish a history of employment in illegal status.
2. Immigrant must establish presence in illegal status.
3. All requirements must be met and affirmed under oath.
4. STRIVE Act doesn't change 212(a)(2).

So, here's the 1-2-3 dance that will become popular if STRIVE is enacted into law.

1. Applicant shows up and submits whatever evidence he has of employment in illegal status and illegal presence. Note that employers are very likely not to colaborate, the risks are immense.

2. Applicant will show up evidence of employment, most of such evidence of employment is also evidence of felony fraudulent acts. (use of a fake social security number to gain work, filing a false I-9, lying to the employer about status to obtain work...).

3. Applicant is denied under 212(a)(2)(A)(i)(I) "admission to the commission" grounds. These grounds apply and may not be waived.

Sure there will be a few exeptions but the program will be reduced to a note in history and nothing else. Is this acceptable or comprehensive? Is this a viable approach aimed at solving the problem in a meaningful way?

Again, this is another example of how real solutions are not even pursued. All that seems to matter is the creation of a conversational piece, something to entertain people for a while, something that will turn the problem into "somebody else's" problem.

Enforcement only is a failed approach. The rule of law first needs to make sense in order to make a difference.

sorry, but we need to ratchet enforcement up several notches....first, eliminate ALL waivers for dirtbags....you commit fraud, adios MF...you lie to get a visa....syonara....
you sneak across our borders and get caught....bye bye Miss American pie....no matter what moron you marry nor how many brats you produce....you are just gone.....besides, who needs you?
No second chances, no "forgiveness" no nothing....
employers who hire illegals get a $10,000 fine for the first offence, $25,000 for the second and $50,000 for the third, can never use the H visas nor file any phony papers for an immigrant visa.....bottom line, close ALL loopholes.....and ship every illegal dirtbag home.....without exception....
