My boyfriend is from ecuador. When he first came over to america he had a visa passport, but now that has expired three years ago. He's still here, working and paying taxes. He and I have talked about getting married (I'm a USC). How can this be done? Is there anyway to fix his status in the US? Does it matter that he has a child as well which was born here?

You can get married then adjust his status in the U.S. Go to the local Immigration and Customs Enforcement office in person to register before you get married.

If what you say is true, you're a USC and he had a valid Visa/passport you may get married and adjust his status. His having a child here doesn't have much relevance at this point. Paying taxes is actually a strike against him due to having an illegal job. The taxes would have been paid under a fictitious SSN.

All that aside, you need to think long and hard about this. Reason being, you would become his sponsor and as such, incur at minimum 10 year obligation to support him in the event he becomes indigent. Divorce would not cancel that obligation.

If the circumstances of yours and his relationship is genuine then his past work and illegal presence transgressions would be forgiven in the process of acquiring status. Again, you are assuming a significant responsibility and the usual role of wife being supported by the husband can easily be reversed by government mandate if your marriage goes south..

I would venture a guess the tide has turned with the absense of a response. Perhaps eyes were opened to other possible motivations.
