In this case, you should show up with your wife and simply explain the situation. You can offer your wife to pay for the divorce and mayvbe give her a $25,000 gift for her nightmare with dealing with you. Abandonment is the most pleasant, easiest and quickest ground for divorce in NY. You can also agree to seperate persuant to a seperation agreement after one year. This may work out best. Perhaps in the agreement, you can agree to give her the $25,000 as part of the seperation of assets. Make sure the wife cooperates and goes with you to the interview. Be very generous !

Affidavits have very little impact for a good officer, the lazy ones, the majority, accept them at face value.

What is important is the relationship, which a good officer investigates and validates by non-publicly available government and commercial databases.

Can't put it any clearer than this NYer:

(2) Termination of permanent resident status for failure to file petition or have personal interview.-

(A) In general.-In the case of an alien with permanent resident status on a conditional basis under subsection (a), if-

(i) no petition is filed with respect to the alien in accordance with the provisions of paragraph (1)(A), or

(ii) unless there is good cause shown, the alien spouse and petitioning spouse fail to appear at the interview described in paragraph (1)(B) , the Attorney General shall terminate the permanent resident status of the alien as of the second anniversary of the alien's lawful admission for permanent residence.

You will get denied. It is not a discretionary decision as you seem to think it is.

Dear immigrants and former immigrants,

I went to the interview by myself. Of course I asked my wife to come with me but she didn't want. "Not my problem"...this is what she said. Once I got to the interview, I was told by the officer that she withdrew her petition. My case is denied. I will reapply the same I-751 based on the marriage that I entered in a good faith. Basically everything the same except the check mark will be "d" instead of "a" on the application form.

The officer told me that they are going to wait until I get my divorce. Once the officer looked at my documents, she said that I shouldn't worry about my future green card. I have enough documents to prove bona fide.

I wish you all good luck and thank you all for your support.

Please feel free to advice if someone has experience with that.

This is another prime example of why they need to polygraph to prevent marriage fraud! What country are you from. No doubt Russia or somewere eastern european meet online did you?
