Just to let you know. I had discussed three cases in the past where all the three countries was under the list of undeportable. Tow of them from Iraq and all family was under Immigration hold including two, womens , childrens are not and was given to their relatives, they were seeking Asylum at the port of entry.
There was POCR rule followed under section 8 CFR Sec 241.5 and both the cases they were out of custody after 90 days, and with visitation. Also I helped get them EAD. Another case, he didnot had any relatives so he was under Indifinate hold and for more then 2 years he was in jail, We did hebeas corpus and released him from incercernation. He also had record when he was incercernated , two times in Hole for 30 days each, because of fight in jail. USCIS argument of dangered to the community was strong enough to hold but his release was done based upon Longer period of incercernation, and limitatiuon of section of 241.5

NEXT I WILL BE POSTING ON LULAC/ CSS LATE AMNESTY CASE THAT IS STILL DENIED ... IF WE WANT TO DISCUSS .. LET ME KNOW

Its a discussion, not a legal advise..

I agree with Old E on this. In order to grasp the entirety of the situation it would be necessary to see all the details. From this it appears they are more or less out on bail since its unknown when and where they will leaving to. Not much of a solution other than being out of jail.

You voted democrat. This country is not worth sneaking into any more.

Let everyone see the facts of the case, the reasoning behind the courts' decision, how was case argued by Immigration and immigrants' counsel.
Briefly share your opinion on case (why you are discussing the case, what points are of particular interest, how the ruling in application and interpretation of statute is different from any other in past or other geographical location and so on).
Then, if it's really interesting, let's dicuss it.

I agree with Davdah, that's a good idea too. Smile Why don't you post a good case E and we will listen to you all senior members here discuss?
