I have an usual question. If in an appeal, is it possible to forfeit the appeal in exchange for a notice to appear?

Yes, I'm well aware of the fact that most sane people would rather wait forever in an appeal, than face a Judge who's main function is removal hearings. In my case, I'd rather get this over with now. I could otherwise find myself in an appeal for 20 years then get the bad news.



The only thing un-American about America, is the USCIS.

I don't think its possible. An NTA is normally issued for an alleged violation. In most situations this is what starts a case.


You voted democrat. This country is not worth sneaking into any more.

In effect you are asking if your appeal could be dismissed and if you could bring your case back to the Judge to start process "de novo".
I don't think this is an option, or too many people with lengthy appeals would simply do the same, have their cases dismissed and appear before Judges once again.

Thanks for responding. I would like you to know that I have never seen a Judge. I would very much like to see a Judge about my case. I think you're wrong about others wanting to see a Judge, most people fear that the most. A notice to appear is one of the most dreaded and feared things an immigrant can receive in the mail.

The reason I want one, is because it would be better for me to be ordered to leave now, rather than 10 years from now. In fact, it would be better to be ordered out now than approved 10 years from now. This is because I cannot make any plans for my future not knowing if and when I going to be removed. It's not a very productive way to live. On the other hand, it's difficult to depart on my own volition when my case is still pending. I'd rather be told to leave, that way I know it's over and I can just figure out how to move on.
