I CHANGED FROM F1 TO H1 LAST YEAR OCTOBER 2004. I CHANGED EMPLOYER IN JUNE AND GOT MY VISA APPROVED BY THE SOFTWARE EXPERTS GROUP INC. NJ.THEY ARE NOT RELEASING MY H1 PAPERS AND THEY MADE ME SIGN A CONTRACT IF I WANTED TO SIGN THE PAPERS. I NEED TO GO TO INDIA IN DECEMBER SO I NEED MY PAPERS ASAP BUT THEY ARE ADAMENT ON GIVING IT TO ME. I HAVE FOUND ANOTHER EMPLOYER BUT I HAVE ONLY ONE PAY STUB FROM JULY AND I HAVE NOT RECIEVED PAY AND PAYSTUB FOR THE PAST 2 MONTHS.PLEASE LET ME KNOW OF ANY OPTIONS THAT I MAY HAVE. THANK YOU.

file for another h1B with new employer, attach the old Salary slip , write a letter that your old H1B employer did not have job for you.
once your new H1B is issued you can travel, till then you should wait.

Is there a way I can get my H1B petition from INS? Also my current employer is not paying my salary. Is there anything I can do to claim my money legally without much hassle?

there is no way to get H1B by yourself. its employer who retains it.
yes there is a way to get salary, you must be sure that your H1B is approved by the same employer.
