canadian citizen is in u.s. visiting u.s. wife. they filed i-130, i-485, g325a, etc. uscis just sent back their docs rejecting i485 because it lists his canadian address as his permanent address. since he is not a resident here yet, he listed the canadian address. should he just refile and state that his current address is here in u.s. with wife? thanks for thoughts.

The USCIS is not used to noble people doing the right thing and asking permission to live in the USA, before actually moving here. Therefore, they will reject any honorable petition.

Sneak in, rob a bank, then apply, your problems will be over.



The only thing un-American about America, is the USCIS.

oops//sounds like rejection is in order.. it appears that they may have missed a few steps along the way.

You have not provided enough information about the marriage and where it took place.

Were they married in the usa and then he went back to canada to await immigrant visa? Or did he go home and then come back and decided to circumvent immigration laws and just stay to file paperwork?

Sounds like I/o was on top of things .

was here on t-1 visa. married in canada in september 2008. lost job in december. went back to canada. returned to visit here in may. filed papers recently. why reject? thanks for thoughts.

Can't adjust status here if you live overseas. Very simple. Refile with correct address, or, if he is actually living in Canada, then see if the I130 is approved then as to be sent to DOS for a visa. You don't have to refile the I130.
