I assumed (prob stupidly) that the Application for Adjustment of Status superceded it?

You said that you did apply for it i sept of 2000.

If your visa expired and you applied for your residence more than 180 days later, then don't leave. They may not let you back in because you are subject to a ban.

Just be patient. It'll be over soon.

It made me laugh when I read that you are so in a hurry to visit yr family who you did not see over 2 years..sorry I did not mean to laugh.. I 've been waiting 5 years and still waiting isn't that funny lol I am though a wife to a USC...have 2 kids
USC... did not commit any crime...did not do anything wrong...did not enter the country illegaly...I just did not mention that my husband was a USC when I asked for a tourist visa from my home country...It was not a lie though cause he was only a GC holder at that time...INS called it misrepresentation ..this is funny isn't it lol
I am still waiting...any hope ??? I don't know...
I hope I will at least have the chance to see a judge...cause I dont want to appeal anymore...all my money was spent on that...the funniest thing is not waiting but I am so scared now to return home....5 years is a long time...will I recognize anyone ? The old folks are like babies...they change in a very short time...well
well...let's wait and hope...it's a hard choice..go back to yr family or stick with your kids and husband...igonizing choice...
good luck to you cynthia..and welcome to the world of patience lol
