I would like to know how to go about applying for a fiance visa? How long does it take? My boyfriend is here from Mexico illegally and we have a child together. He has not signed birth certificate so there is no "proof" that he has been here. How would I go about getting the visa without lettingINS know that he has been here. I do not want him to face any penalties.

I think on the forms, it's going to ask if he has ever been to the US. What are you guys going to do: lie or tell the truth and probably be denied?

Also, you have to prove on a fiance visa that you have seen each other face to face, either by him coming here and leaving again or by you going to mexico. If you do that, you'll wind up lying a lot through the process. If they find out, you're going to be in bad shape.

You probably need to wait until the 245(i) is reinstated whenever, if ever, that will happen.

i have been over to mexico two times now so I do not know if that would work or if we said he was here and then left(while I started the petition) would there still be penalties?

If it's the same as the one that ended last year, there would be 1000$ penalty fee. Again that's if or when they reinstate the 245i.

It's up to you as to what you do.
