My mother has been in this country for 34 years now as a permenent resident (green card) just a few months ago she recieved a letter from immigration after filing for a renewal on her green card.. she has 3 attorneys right now... basically the story goes 24 years ago (14 years after already being in the country as a permanent resident) my mother and on of her divorced husbands got into a custody battle for my oldest brother. At one point his father told my mother that as far as he is concerned his son is dead to him.. so my mother moved away from her former husband.. a few months down the road he filed for what seems to be kidnapping/child abuse charges. My mother was forced to go on probation and took a plea bargain for no contest (which she was threatened with that if she didnt the concequences would be higher). As time goes on my mother won the custody of all 4 of her children from their fathers. Now immigration seems to be starting to form a case where my mother is a permenant resident who is a criminal (which is rediculous... all of us love our mother to death... even when we dont agree with her ) What I would like to know is what are her chances of staying here, and how could immigration not concider all factors involved...

I really dont know the answer to that.. I think that under the advice of attorneys she has been told for years to just to renew her green card due to the waits on naturalization... only now have they brought up naturalization to avoid dealing with that department of immigration

Kidnapping and child abuse are very serious convictions; it does not matter that she plea bargained; she had a bad attorney

I did read his posts... he seems like a bitter person who really has no real like for other cultures.... but the real item he is missing here is that the united states was founded by immigrants.... this is where people come to have their freedom from other chained societies...

If the problem is the conviction, then you have to find out what she actually was convicted of. Small differences and even details in the wording of a statute usually make all the difference. She entered a plea or so you said, so it's what's in that plea agreement that controls, her admissions.

You have to find out what she was convicted of, the sentenced imposed and the exact wording of the statute of conviction before you can arrive to any conclusions.

What is really wrong with this is that she was successful in alienating you and your other siblings from your father(s). She moved away from the dad(s). Real nice.

Did it ever occur to her that children are supposed to have two parents. Geez, maybe there is a reason for that. This is a classic example. The truth is, this may be a shocker. She did all this jumping around so she could replace the existing father with the new boyfriends. I bet she told you guys each time to call the new guy 'dad'. The problem is the new guy didn't really want to assume the position. Hence the reason for the many step dads and siblings with different last names.

Your mother did a great disservice to you. One of the dads had to go to the extreme of bringing in law enforcement to get his place as the father back. I'm sure you were told such terrible stories of how your dad didn't want you, as you stated. Funny though, if that were true, why the kidnapping charges? That my friend is part of the game. To get you to hate your dad so she could continue her selfish escapades. If she really cared she would have made sure you were close to your father. But that would have gotten in the way of her romantic desires. So you and the rest of the kids played second fiddle.

Now this comes full circle and its time to pay the piper. This probably falls under crimes of moral turpitude. If it is then she will be gone. It might be a good idea for you and your siblings to seek out your fathers and hear the rest of the story. Bravo USCIS!, at least part of our judicial system recognizes the importance of the 'other' parent and makes the punishment fit the crime.

davdah... actually you are fabricating a picture that is not at all the truth.. after my mother won the custody of her children IN COURT, she proceeded to get child support from my father (with all this said and done all of us were living in the same state/city) after the ruling of the court for my father to pay the child support came HE FLED the state... my father is a horrible person .. not from what my mother TOLD me but from what I have SEEN MYSELF.. becareful of how much you decide to read into something you know nothing of... this whole situation is nothing more than an act of revenge from my father.. I dont think you get that.. my mother has nothing besides this.. not even a speeding ticket...If my mother was such a bad abusive person I would not be blogging on a forum with so much concern.. especially concidering the fact that I support and take care of myself... Im not worried about losing my home or food on the table I'm worried about someone who has truly always been there for her children every.. last.. one of them.. through thick and thin
