attorney can ask anything, may be 10K who cares... only thing he will do is to file an appeal for 485 and thats all. let me clear myself. Your brother case has political asylum case. Filing I130 does not make two cases, its a start up of AOS which you guys filed and I130 was approved. IJ was right and did the right thing, Court never have jurisdiction over I130 , jurisdiction always resides with DHS. once its approved next step is to file and adjucate 485. Ij waited for I130 approval and once approved he has ablity to approve your brother's AOS. I guess your attorney don't know that or He might be careless or pwant to prolong tha case so more longer he drag the case more he will make money. No hard feeling , thats the truth. Go take second openion you will know. My question how do u know that AOS was denied by Officer becasue of wrong answer? second Once your Case is reffered to Immigration court DHs lost jurisdiction over it and they cannot adjust you because political sace is pending. How come you guys didnot ask for new early date ofafter approval to court hearing of political asylum case and adjust your status in court? this is thr right procedure. ask your atorney why? Next step, File Appeal in District office for AOS. let me know the asnwer of your attorney and I will guide you. These fre aking attorneys messed up every one.
