What is INS' prcedure for investigating possible marriage fraud? An immigrant married a US citizen for the sole purpose of obtaining citizenship (it is common knowledge to people who know the situation). At the time of their marriage (about 3 years ago), the immigrant was out of status (some 5+ years, she had a visitor's visa). The couple is no longer together, and the US spouse is threatening a divorce. The immigrant now has a newborn (father is not her spuse), she is not living with her spouse and has no source of income. She and her spouse are still awaiting their interview. What is the likelihood of her obtaining citizenship? Does INS routinely look into marriage fraud when one is trying to obtain citizenship through this avenue? What about the couple no longer living together and the immigrant unable to support herself? What about the baby who is a US citizenship?
Also, how is it possible for her to get a drivers license and a SS number (she is not authorized to work in the US)?

If they haven't had their interview yet things look grim. If he is going to divorce her, is he going to go to the interview? They have been married 3 years and could claim that the marriage was in good faith. That's really up to them to sort out.
The INS will look into marriage fraud if they feel there is a reason.
The child being a US citizen can only sponsor it's mother when he/she turns 21.
It doesnt look very promising if you ask me and it all depends on what he wants to do. Why is he threatening divorce all of a sudden? Is he still going to go through or is he planning on coming clean with INS?
As for the SSN and driver's license, I have no idea. Did she not get a work permit from the INS to work while she is waiting for her GC application to go through?

immigration should investigate all marriage cases for last 15 years and should penalize for 20 years for marriage fraud.
