WE BEEN LIVING TOGETHER F0R 3 M0NTHS ALREADY... HE CAME iLLEGAL 2 DA UNITED STATES HE IS FROM H0NDURAS AND I AM A US CUTIZEN AND I WANT TO KNOW HOW CAN WE GET MARRIED? HE HAS NO TYPE OF LEGAL ID OR ANY OF THAT STUFF I MEAN HE WANTS TO GET MARRIED WITH ME BECAUSE HE LOVES ME NOT 2 GET LEGAL IN THIS COUNTRY BUT I STILL WANT TO HELP HIM SO HE WONT HAVE ANY PROBLEMS IN THE FUTURE CAN YOU PLEASE HELP ME ON WHAT TO DO? AND WHAT IS REQUIRED FOR US TO GET MARRIES HERE IN ALABAMA OR IN FLORIDA? THANK YOU

You are probably wasting your time. The fact he is illegal and never had a valid visa means he is not able to adjust status. He will have to leave no matter what and return home. Reason being he will need to do what is called consular processing in his home country.

The next thing he will be faced with is a ten year ban on re-entry due to being present without inspection for over a year. The only way to get past the 10 year ban is with a I-601 hardship waiver. This waiver must show extreme hardship to the USC only due to the absence of the spouse. These are not easy to get and if you aren't even married yet, its a lost cause.

Before anyone can give you advice, you will need to provide more than general information.


How did he come to be in the usa? Did he arrive with a visa/came as a tourist and overstayed?


Did he sneak into the country to be here illegal?

Did he come here and ask for TPS (temporary protected status) Ask him about this.

Answer these questions and ONLY then you can be advised.

..Davdah..u state that the hardship waiver is a lost cause for unmarried persons? is this absolutely true, i want to know if we should pursue it...we are only engaged, and my fiance is being held by ice for now....i was wondering about getting lawyer to help get a pardon for him...idk what to do. we arent married, but want to be. is it really a waste of expense and energy to fight this? should i just get my passport and move to brasil w/ him...seriously.

The hardship waiver only applies to family.

If you marry now it probably won't help for a couple reasons. One, it will be assumed the marriage was for immigration benefit. Two, in order for the hardship waiver to carry any weight at all there is an element of time required. An established amount of time where the need of the immigrant's presence has been given to service the hardship of the USC.

The hardship must be to a US citizen and be extreme. An example would be it is necessary for him to stay due to the poor health of the spouse. You may not like this but his only redress is through his former family. Those children are his and may qualify in a hardship waiver petition. Which would necessarily be filed by his former wife.


There is no pardon, this isn't technically considered a criminal action. If you hire an attorney you are probably wasting your money. The best they can do is voluntary departure. Which your fiancee can ask for at his first hearing date on his own. They give those out more or less upon request. The benefit to this is there is some hope of a future return. Albeit around 10 years unless other circumstances change.

davdah is right. The hardship waiver isn't easy to get. You might try this site for more information on the I-601 waiver. They have quite a few people on there in similar situations to yours.

There is nothing stopping you to get married. He will need ID to prove that he is who he says that he is. ID from his country is fine. if he was married before in his country, he will need a copy of his divorce certificATE in order to be married to you.

If he does not have id, tell him to contact his family in his country to send him ID that he would have had there by way of DHL or some secure mail .

Best wishes to you both .

please check out the things that I mentioned above. He may have been eligible for TPS when he came.

hello..i would like to say, that if i knew then what i know now, i suggest that you go back to honduras or whatever country he's from, and marry there..do this legally, and swiftly. Its too late for me and my fiancee, and i wish we didnt wait.
