I'll make sure my attorney brings these facts out if CIS tries to adjucate my case as LIFE.
The Lulac/CSS settlement is very clear as how to handle these cases. Specially CIS has been ordered to take in consideration the passage of time and the difficulty of obtaining numerous pieces of evidence. The settlement also says that CIS can't deny a case just based on affidavits, (but I do have school and social security records though). The settlement calls for "preponderance of evidence" which stands for "It is not determined by the number but by the greater weight of all evidence"
Also, if you appeal, the judge usualy asks the CIS the basis of denial. If the CIS can't prove that the evidance if not true, then the judge usually leans towards the applicant. You can see this by looking on past appeals.
I won't let CIS go without a fight, all the way. Money not being a problem, I can ride this for a long time if necessary.

Nice, yeah, my appointment is set for Oct.20th. in Los Angeles. - funny, I know were the Soto office is, there's were I first tried to submit my application back in the 80's!!!
Besides affidavits, what other proof are you going or have given to CIS?
Make sure you also bring a current passport.

Had interview in Miami. Life Application is in one hand of the officer and Lulac the other. Therefore, however your Life application was treated, whether it was denied or it was a withdrawal, the end result will be the same on the Lulac. Without an overwhelming amount of evidence, eg School records, medical records etc, affidavits alone are not within itself a significant evidence, at least in the Miami office, contrary to the settlement agreement. Ambiguous information being conveyed with regard to being able to renew EAD. I suggest seeking legal counsel to make an informed decision, as ultimately each person will have to make the decision that he or she thinks is in their best interest and hope for the best.

I am a lulac pending case. I am now outside US on avance parole. I am also eligible for employment based H1 visa. I am thinking about withdrawing my lulac claim and apply for H1 visa. My question is, even if I widraw the lulac claim, will it interfare with my H1 visa approval or processing in future? Can anybody explain/opine please?
This is very embarassing for me but here goes the story. I have two families who are relatives of mine and last December 2005 they traveled to Dallas, TX to see a so called INS retired employee who was helping out people with there LULAC/CSS apllications for a modest $6,000 telling them he had "inside" connections. All the information that was used on the appl. was false, they also used fabricated dates and affidavits and what have you, when in fact they only arrived in the US T THREE YEARS AGO. So far they have gone thru all the expected stages (biometrics, finger prints, etc.), in fact they already have their California Driver's License and SSN, temporary of course. Furthermore, they all have their interview set for October 23 & 24, 2006. I am in AWE and at the same time ashamed with their lies and fabrications, and I have the funny feeling they will succeed, as I was told by them that another one of the "so called ex- INS retiree's" clients was approved last month in Dallas, TX.
My relatives & I are here in Northern California, they will have their interview in the Sacramento office. Crazy ain't it?

How did your interview go?
I had mine this morning. It went just fine. Officer told me to I would receive their decision in about 30 days. She said everything looked good.
I asked her if she had the authority to approve right then, she told me that she didn't. All she does is to interview the application and to make sure the application is complete and to go through the evidence presented. Then she makes a recommendation to the District Supervisor who signs the final approval.

The officer did not asked to see the original evidences. Officer asked me for my health exam. The interview took about 1 hr.
The officer was very polite but firm. I was with my lawyer though. So I don't know if that mady a difference on how they treat you.
I live in Los Angeles County. I went to the Soto agency.
At the end, the officer told me that I would have to wait approx. 30 days for a reply from USCIS. The officer also mentioned that is the District Supervisor the one that signs the final approval.
Freedom 1, You say your interview took about an hour, that's a lots of time for an interview. How many questions the immigration officer ask you? And what kinds of question they ask you? are you css or lulac? My interview only took 10 minutes and they told me I’ll hear from them after 30 days, now its 9 months and I did not hear anything.

Yeah, the lady was kind of old, so she was taking her time with the paperwork and questions. Then sometime she would go back to her notes to compare with my answers.
She seem to be more into to when I arrived and how many times I left the country. She did not asked me a single question about my past employment. She did asked me questions about when I used to go to school. She also asked if I'm merried and if I had any U.S. born kids. Also, about my current employment status and what I do for a living.
I'm CSS, not Lulac.
My lawyer told me that we're going to wait the 30 days the officer said it was going to take for an answer. If we don't hear back from them after 30 days, the my lawyer if going to do an infopass apointment to talk directly with the officer (we have her name) to file an inquiry.
At the end of the interview, my lawyer asked the officer if she needed anything else from us and she said "no" everything looks fine.
My lawyer told me that under the CSS/Lulac settlement, the USCIS have to adjucate these applications within a period of time, unlike LIFE applications were they can just sit on them for ever.
