My father's brother had filed a petition for my father in 1985 which included all of us children under F-4 category.At that point of time my age was 12 years.But the petition was approved in 1997 and my parents got the green card in 1997.But i was left out as i was over 21 years of age.But my question is that will the new child protection act help me,as when my uncle had sponsered my father's petition i was only 12 years of age and my name was included with my father's petition application.

with regards to your case, you cannot anymore avail of the child age out law since as the new law provides one of the conditions to be met before you can avail the benefits of this law is that your parent ( main beneficiary ) has not yet been issued a final determination meaning they havent been issued a visa but as you said they already have a visa issued then you can no longer avail of the child status protection law.
the only for you to get an immigrant visa thru your parents is for them to file you another visa via f2b which will take many years again of waiting.
the new law is so strict and has conditions to be met.

Thanks Antman23 for your advice. You've confirmed what I understood from thoroughly reading the law. Unfortunately my son cannot avail of the law either. However, per Bugsy's advice let's wait for the rules & regulations to make sure.
