Hello everybody, I few years ago my father (LPR) petitioned my sister. He just became a USC and he wants to upgrade the petition.
1. How does he do that? (is there a form or does he have to send a letter?)
2. Once the Embassy receives the documentation, can my sister "put on hold" her resident visa? Right now she doesnt want to move to the US. She is happy in my country and doing very well financially. But things may change in the future.
Since your father had become a citizen, he can upgrade your sister's Petition at any time. First he should have the copies of I-30, he must have received the Notice of Action that your Petition has been received, which will have your sister's file # on the top left hand corner, and date of filing and date of receipt in the USCIS office. Important is this he should have his Certificate of Naturalization with him when he calls uscis. Once it is up graded this will be forwarded to NVC, which will take near about 6 months time to be sent to your home country U.S. Embassy, or Consulate General or Consulate Office is located. Once the Embassy received it it will go according to PD and she must use that date within one time. After that they will cancel her Petition and sent back to uscis. Then you father will have to file again. which might take longer time then this Petitions. Processing might take near about year or so She can always go back on Permit to Re-Enter United States for one year and 11 months from the date of her Re-Entery Permit.

It seems she cant put her residency "on hold". I dont think the re-entry permit would work for her since you probably have to apply for it in the US and wait a couple of months to get it. Right now she comes to the US twice a year for a couple weeks just to visit our family but she has no interest in staying any longer. But like I said, things can change in the future so it would be good to have LPR as Plan B.
