If you want to use the analogy, analogy so be it. In legal system there is what's called "motion to quash" an indictment (or even subpoena/summons). But there's a catch, it's more reasonable for the prosecution to file the motion to quash than the defense. Say, in the instant example, Explora were the plaintiff, Beverly were the defendant, while Sam were the Judge. Explora could petition Sam to stop the proceedings as no fair judgment could be arrived at given the initial evaluation of evidence and facts of the case. But the accusation of wrongdoing is still there. Being so, the accused should desist from committing the same offense further, incarcerated if need be. And once everything is well, then the trial would proceed. Looking at it this way, it makes sense to me.
