Someone help with this please. According to Ruiz-Diaz court order and the USCIS (Nuefeld) memo. Can I re-file my I 485? I filed my I360 in October 2001; Approval came in 2003 and then I filed my I 485. USCIS denied my I 485 citing I was out of status. based on this new ruling, can I re-file I 485 seeing that my intial I 360 filing was in 2001? The USCIS memo says it will accept I 485 re-filing if concurrent I 360 and I 485 could have been filed after July 31, 2002.

Thanks for your input...
