Hi all, can anybody give some advise on this!!

A canadian and son came over to US, passport is stamped at POE, in December, she is visiting relatives, during her stay she marries a USC in March, (she has known the USC for a couple of years) they have filed AOS package. but is worried and stressing out thinking she will be denied and banned.

Q1. the stamp she got in her passport is it valid for 3 months?

Q2. if yes to above question this means she hasnt overstayed for more than 180 days, should she abandon her AOS package that she has already filed in late July, and return back to Canada, and file for K3 visa.

Q3. If she goes ahead with AOS in US will her son have to attend interview.
Any advise appreciated.

Sometimes the answers are under our nose. In this case under out post. The one just prior to yours 'Chat transcript' has a note in there about this. In short the AOS won't be a problem as long as there was legal entry. If the son is under 18 probably no interview required for him. A slightly different set of forms though.


You voted democrat. This country is not worth sneaking into any more.

Thanks Davdah, I have read that, but... what would happen if she cancelled her AOS application went back home and applied for K3, can she do this, or would it cause problems when they re-apply

Depends on how long she overstayed if at all on the first visit. If she did then a waiver may be required. If the oversaty was less than 180 days then it should not be an issue as far as I know.

Not sure if it happens to everyone, but my son had to go to the interview with us.
He was asked just a few questions, like school and so on.
I didn't think he had to attend but they said he had to. He was 12 at the time

A1. Canadians are normaly authorised to stay for 6 months as tourists

Q- why is she thinking about abandoning AOS?

She is terrified that her application will be denied, if the Canadian tourist visa is for six months she was only out of Status for 1 month which is a good sign for her, I think she is worried incase she has to prove she did not intent coming here to marry, she has now registered, Marilyn. where are you!! I was hoping that you Aneri, or Hudson & Needhelp would reply to these questions so thank you.

hey someone 12.. just wondering ? does moments of (if you have any) being a compassionate caring human being cause you great pain?? maybe you were held too little or too much as a child . whatever the case will be ,the reason the world is the way it is today ..is bc of ***'s like you. we are all human here. well besides you of course. i dont know who you are and , you dont know me . you have no right to judge anyone on this forum .take a look in the mirror .. sooner or later you will see the only ****bag on here is yourself
