my husband was arrested for assault and they put a detainer on him. what can i do to try and help him. he is illegal but we have 5 week old twin boys and i am very sick i have a chronic sickness which puts me in the hospital quite a bit. he is the sole provider for me and the boys. i would like to know if its possible to start his i30 and if i can get him out of jail so please i really need your help

You need to contact a good immigration attorney. Don't rely on advice from this forum.

Hi, it is quite a serious situation. He could be removed quite quickly. Have you not yet applied for his Permanent Residency? Did he enter the country without inspection (cross the border illegally)?

As ProudUSC says, a lawyer is a must. Advice on here is from lay-persons like myself.

If it's not fake you got yourself some serious problems.

Being illegal and in custody for what will likely be determined to be a CMT in the eyes of USCIS is a tough road to hoe. You haven't even filed an I-130. At minimum, he will be sent home. There is no staying here to adjust status.

Once back, you're looking at filing an I-601 waiver.

For the time being, even if you post bail for the criminal act there is a good chance he'll be remanded to the custody of USCIS for immigration violations. You need a lawyer. This goes beyond the capability of what you can find here or on any immigration site.

The CIMT would be bad enough but if they determined it to be an aggravated felony then he could be removed administratively meaning he'll never get his day in court and could be gone in a week. That would be the worst case scenario. What was the assault for? Was it DV or something else?

People with chronic diseases can absolutely have babies (and she didn't say they were full term). It's not always advised, depending on the condition, but it is certainly something that can (and has) happened. Even women with cancer have given birth to perfectly healthy children.

Nothing you can do but hire a good attorney. Do not rely on the local public defender. Public defenders just negociate plea deals.

ok FIRST ITS NOT FAKE second i have panccreatitis. i had my twins by emergency csection when i was 35 weeks preg they were in the nicu for 3 weeks they weighed 3lbs 11 oz and 4lbs i wish this wasnt true. we didnt start his papers cuz i have been so sick since march of 08 in and out of the hospital there was never enough money for the lawyer. so i really dont care if you believe me. all i wanted was some advice im alone and scared and dont want to lose my husband. its a second degree assault and they say its a misdemeanor. so thanks to those who have taken me seriously it means a lot. and to those that dont believe me please come trade places with me im about to lose everything cuz i cant work and my husband was the one paying all the bills so all i wanted was some advice sheesh. thought you people were a little more grown up on here.
