I need some advise fast. I was divorced and hence did not apply for 751 until I got my decree. As soon as I got the decree from courts (3 months after the 2 year anniversary), I applied for the I-751 waiver. Since then I got the NOA whic extended my GC stamp on my passport by one year.

Today I decided to get another stamp on the passport since I will be travelling out of the country for business. I asked my lawyer to get it done for me, and she gave me some bad news. She said taht the immigration officer told her that two weeks prior to when I applied for the waiver, my status was terminated !...

Now I am totally confused which is true. My lawyer suggests that I let nature take its course, it will probably go to a judge where we can explain the situation.

I want to know if anyone else has gone thru something similar, and what are your thoughts. I do really really need to travel for business or it may cost me my job.

u have the right to reopen a motion for ur i-751,,dont make that mistake and leave the country,,and something does'nt sound right here,,u said the immigration have told ur attorney that? if i was u i wont believe anything untill i get something in wrinting from the immigration?have u? they cannot just say denied or whatever without sending u a letter?who got it?and how long u were married for?like i said ,,iam sure that u can reopen again,,and all this if u c the letter was sent from the immigration,,,but if ur second motion gets denied then that wont be a good thing,,but trust me,,removal proceeding takes for ever,,its not like ur ganna be deported in 2 weeks ,,nop,,,and make sure to ask for that letter?to me i will get a better attorney,,bcoz this is sensitive case to reopen the second time for ur i-751 ,,,good luck

and u have to prove that u entered the marriage in a good faith,,and how long u guys were together ? and have u filed a joint tax return with ur ex? all this make a big diferrent for the immigration,,,if ur attorney is not helpingu then get another lawyer who will help u ,,,bcoz if u do this right then u will be able to remove the condetion of ur green card,,even if ur divorced

If you fail to get your conditions removed, your status is automatically terminated AS OF THE TWO YEAR ANNIVERSARY of being granted conditional status

dont listen to this jurk,,,hes a dump idiot and doesnt know what's he talking about,,,hes ex wife dumped hes *** bcoz hes *** and she divorced him and went with hes best friend and marry him,,and he tried to get her out of the country and he failed,,and thats why hes mad,,dont listen to him,,yes u can remove the condetion even when ur divorced,,and even if its get denied once,,u can still refile again

Yes listen to Mike_2007 (a great speller) instead of me in my last year of law school AND your experienced licensed lawyer ; don't know why you bother with the lawyer. Fire your lawyer, ignore my good advice and listen to Mike_2007's advice. DO NOT FOLLOW YOUR LAWYERS ADVICE; FOLLOW MIKE_2007's advice !!! I wish you as much luck as my ex-wife got.

Thanks Mike. My case is strong. I have all the neccessary things plus more. Marriage last 1.5 years so i got leases, financical docs everything else they list. My lawyer seems to think its a strong case.

Now, there was a memo that for I 751 if your in the divorce process, to then wait for the divorce decree before you apply. So I waited and that took my beyond my 2 year expiration date. Once applied, I got my one year extension in the mail.

Currenlty I have an urgent need to travel outside of the country - i asked my lawyer to get me a stamp on my passport, when he talked to the officer about it, they said that my status was terminated two weeks prior to me filing the 751. Now my lawyer, the immigration officer and me are all confused. We could just play the waiting game to see what Immigration does wiht my 751, I have already had the biometrics.

thats the proble,many people take it as not important.Which is to file your I751 application time.Its not a choice,its the law of immigration.

Your case was a tough one because u had to wait till you are divorced...but u could have also asked immigration to extend some time for you to have your divorce decree...some do that and some officers at ins grant that...

but i am sure the judge will gant you that,since u ONLY were late because of the divorce decree...otherwise u could not sent in your application...

good luck...and check with your attorney

do you think i should just wait it and see if ins assigns me a 'judgement day' while processing my file - or do u think i should go into an office and explain them my situation and see if they can update their records so that i can travel outside the country. i have to travel i would be at risk of losing a job if i dont. Is there a way to schedule an appt with a judge myself ?

listen conditional-resident ,,my advise for u is not to leave the u.s no matter what,,,trusy,,once u leave the country ur done,,then u will lose ur status for sure,,right now u dont know whats going on but u still have an options,,and like i said before the immigration wont go after u now,,,ur case will take for ever for them to do anything about it bcoz ur in the u.s,,but once u leave then thats it,,i wont leave until i get some kind od extentions or travel documents or anything that for sure,,,and hahahahahahha sonofmichael ur at the last yaer of law school ?hahahahah what a sick idiot ur ,,maybe u spell better than me,,but at least my a s s didnt got ump like urs u g a y mother ****er,,,why did ur ex divorced u michael?ha ,,why?and i will tell u what did she got from u exactly.....she divorced ur a s s and got her green card and thats what is killing u ,,ha michael,did u notice that he didnt even answer ur comments,,,bcoz everyone in here know's that ur junk,,and trash,,,stay away from me a s s h o l e

I want to go in fron of the judge at this point, explain my situation and get it all straighten out. Any suggestions on how to get an appot with a judge, can this be done pro-actively.

hi condetional-resident,,well,,iam not sure about if u can c the judge directly,,,hmmm,,actually i never heared of some who made an appointment with a judge,,specially the immigration,,i might be wrong,,but really i never heared of such a thing ,,i think the only way to c him if u were in deportation procedding,,but iam not sure,,unless if attorneys have access ,,but my question for u is why do u wanna c the judge anyway?u dont have to explain anything to him,,u werent placed in a deportation proseeding?u weren't arrested by the immigration,,i think u still have an option for a waiver or something,,but listen,,dont do anything on ur own,,ok,,dont ,,get a immigration attorney,,bcoz if u do it on ur own,,then its little risky,,dont risk it,,i can give u a few phone numbers for some good lawyers and they dont charge ,,and hes the only lawyer that i have seen so far offer special service for even illegal aliens,,he wont charge u for consultation here is the link ,, http://www.advancedimmigration.com/ good luck

make an appointment and talk to and Immigration Officer about your case

My lawyer created such a mess in my case that took me 2 more years to finalize something no so complicated.

The only thing: I wouldn't leave the country if I was you.
