This is a question regarding the waiver l need to apply to come back to US. My ex-husband and l were deported from US based on the denial of our political asylum. We fought all the way with the immigration court system, and failed. In the meantime my ex-husband, we were still married at the time, was waiting for his labour certification to be processed, as a chef. Our marriage ended when l found out he had an affair and a child was born as a result of it. We were still leaving in the same apartment, and didn't get legally divorced until we came back in our home country,Albania. He was the only one detained, l was released under an order of supervision and regularly reported to ICE until l made my travel arrangemens. While l was in US l met a wonderful man who was devasted by my story, and truly fell in love with me for who l was. He wants to come and visit me here in Albania and has proposed marriage. We're still daing at the moment, and l don't want to rush into any hasty decisions. As much as l want to come back to US, l resided there for 11 years, l still want to be with this guy for the right reasons and not just for the green card. We have a lot in common, our profession, our past, our religion,etc. If we were to get married in Albania, he is a US citizen, and it's very costly for him to travel back and forth, since he's got to take care of his daughter from his previous marriage. What do we do first, file the I-130, then the waiver, does he need to submitt a letter with my waiver? Also when l left US last year, l wasn't able to pay off all my credit cards, l had excellent credit in the past, now my credit is ruined, will that play a role when l apply for my waiver? Please, only helpful comments, l really appreciate it.

hi lori31,,,well,first let me answer ur question about the credit,,no it wont hurt u even if u have filed bankruptcy,,the imigration dont check the credit ,,i know someone who waited for hes i-130 to get proved ,,and hade a previous status before and ther was a 3 law suite againts him and he was still able to come back,,dredit problims are civil matters,,so dont worry about that,,and about the waiver yes u need to submit a letter with it but its always better if u have an attorney handle the process for u ,,,iam not sure about how long will take ,but i will say about 1 year,,and iam also not sure if he can file for k-3 visa for u after u guys get married,,,bcoz if yes ,,then this will be much faster than the i-130....so good luck and sorry to hear about ur ex

Mike, thank you very much, this helps a lot. I was afraid l was going to be attacked by hurtful comments, by Someone 12, or Sundevil. I still might, but it's good to know that there's honest members on this board who understand real dramatic issues and try to help in any way they can.

yea sure....another marriage "for love.." and how is this philanthropic village idiot supposed to prove 'extreme hardship' when you two have zero children together, you don't support him financially,etc.....yea, I'll bet this is a 'true' marriage, about to the extent that mike-2007 has an IQ above 75.....

why be kind to a visa cheat? To a sham marriage practitioner? These people just want to scam their way into the US and then start scamming more undeserved benefits from hard working taxpaying Americans....sorry, but I have no soft spot in my heart for such individuals.

Hey Someone12...I don't know abut you, but I'm a victim here as well. I have been cheated, scammed, stolen from, lied to ... as well, by my now ex-husband who is presently illegal, and I'm not happy about it At All!! He is/was a true con-artist and sociopath!! A real winner!! Talk about loosing nearly everything ! No...I don't have any 'soft spot' in my heart either ~ not for people like that...no way, no how! And, just for the record... I'm not trying to be vindictive about his being here in the USA...I am a good, fair and honest person. HE is a true 'user' and abuser, and for the past four years I have been IN contact with USCIS who either doesn't have the manpower to do anything OR they just don't seem to care! So now he's here ~ he's remarried ~ and a minister ...IF he could do something MORE to be "permitted" to stay here, I guarantee he would have done it by now!

The point I'm trying to make here is that people shouldn't be so cruel to others...and now that I look at this particular post...this wasn't bad at all ~ I saw several others (while flipping through the posts) and it just amazes me how people, in general, seem to enjoy such name-calling & tearing others apart! That's all.

at least you have apparently come to your senses....and I wish USCIS would track your ex down and deport his butt (along with Jake, since she apparently can't find the nearest airport)...
your situation should be a wake-up call for many Americans considering marrying some douchebag that has scammed his or her way into the US of A....they are after one thing and one thing only....a green card...and they will lie, cheat, steal or do anything else to get one...think twice, thrice and maybe more before marching down the aisle with a border jumper or visa cheat....ask yourself (seriously)...if your significant other refuses to obey even simple rules, what does that say about the character (or lack thereof) and morals of this person? Yep..it says theirs are at the bottom of a cesspool.

Yes Jake...and if you didn't know it by now, we're ALL on-the-hook and will continue to be on the same one for some time, and withOUT being able to get out of all the legalities attached to it.

My ex told me he had enough money back in his country, so he could retire if he chose to do so. WRONG!! Looking back, I wish I wasn't so trusting! Instead (like many others, I'm sure) I was foolishly CONNED !

I should be the POSTER CHILD for others! I've BEEN at my senses for a Longgggg time! I've done almost everything, except for driving USCIS TO his front door ...maybe that's what I need to do.??

At least if I was 20 years old and this happened to me, I'd say that it happened because I was "in love" with this fool. But I'm NOT 20 ... and it's me who is the fool! Live & Learn...or not!

Oh, and just for the record... I'm NOT calling any 20 year olds FOOLS ... I'm speaking ONLY of myself! So please don't rip me apart. Thank you!

YIKES !! Seems like my words have been seriously taken out of context! ?? AND...you're right Jake01...I don't know your situation ~ and for that reason alone, I wouldn't attack OR judge YOU, or anyone else for that matter!! We've had to live through the horror's that we've been put through by too many people...Thankfully we've survived! ...hopefully unscathed and unbroken!

The jist of what I was attempting to say here is that (a) people shouldn't be so cruel to others (even though they probably deserve it); (b) That those of us who have who have signed & completed the I-864 (for these certain scammers who prey on others) will, unfortunately be forced to remain on the hook & legally responsible for those who have CONNED many of us...until such time as they meet the requirements set forth by USCIS; (c) That I AM A FOOL! and I've learned my lesson the hard way!


2guns A message especially for MY EX-HUSBAND...and to ALL you scammers & wanna-be-scammers out there who are trying to beat the system and gain citizenship by ILLEGAL MEANS... AND by taking advantage of SO many of us who do not deserve to be treated unjustly or in an ill mannered way... just so you can have it your way...:

It's time for you to: (a) GO BACK to your own country ~ where you belong...; (b) Find some other country which will accept your B.S. ~ perhaps a deserted island with no other inhabitants; (c) (my personal favorite) Crawl back UNDER that ROCK that you climbed out from! 2guns

dear Got-Faith: Jake forgot to mention that she is one of those scammers....yep...she arrived as a lying "tourist" about 3 years ago, told another lie to our border folks that she was planning to stay '2 months' (are British calendars different than American ones...??...mine shows two months as about sixty days....apparently Jake's idea of 'two months' is more like 1000 days....very odd)...instead of returning to the UK, under the terms of the Visa Waiver Program (Privilege, not a right) she found some village idiot to marry and is trying to get a green card and remain in OUR country...so tune her sorry sodding behind out, because she is just another visa cheat, like so many that are taking up American oxygen in OUR country and need to be deported ... tomorrow.

Dear GotFaith...just ask Jake the VWP cheat the following questions (and then see if she has the courage to answer)
1 - did she return to the UK within 90 days of her admission as promised?
2 - has she ever gone back to any airport and made any attempt to return to the UK during the last 3 years?
3 - did she marry to get a green card? (she will lie on this one)
4 - did she lie to our border officials when she said she was going to stay '2 months' (it is a certainty she did not tell them she was planning to stay at least 3 years)
5 - has she tried to rationalize or justify her irresponsibility, lies and BEE ESS from her very first posting?
6 - why hasn't she returned to the UK? Is she handcuffed to a wall? Is she in a coma? Have the airlines stopped service to the UK?
7 - Why does she think she is above the law?
8 - What is she hiding?(since she never answers any detailed question about her transgressions, lack of moral character and ethics)

Just because I overstayed my visa, doesn't mean I am conning my husband, or that I am a welfare leech, I have never claimed welfare in my own country, I dont intend to claim any in this country. so quit the insults and try being more productive with your comments.
