As far as I know (I'm not a lawyer) you don't have to include your wife in your green card application. If you don't, and decide to bring her after you get the green card, there can be a long wait. If you don't have a genuine marriage (and from the sound of you don't), it might even be construed as fraud to bring her.

need help, r u hiding something ? how does it matter if you mention you are married on INS application ?
r you afraid that your wife will get GC ? whats the problem boy ?

It does matter what I mention on the application....as it says on the application that all the information I give must be true and I can be found liable for perjury and subsequent deportation.
Hence I do not want to lie on the GC application.

I do not want to bring her anywhere. She is in the US anyway, living her own life. SO no question of me defrauding anyone to get her here. Remember my marriage is in trouble and I want a divorce.
I only want to know the implications of mentioning my marriage now on the GC application for her? Or should I just wait, get a divorce and then apply for the GC as "Single"?
Whats the better option? OR it does not matter?

Hi Need Help  , I don't understand your hesitation  .... Your marriage is valid in USA if there was a ceremony performed in India...simple as that....because USA recognizes ceremony based marriages placed in India according to country's customs and rituals ... you are a MARRIED guy... without going here and there... if you don't want to stay with your wife...file for divorce tomorrow and petition for yourself only explaining to BCIS that you have already filed for divorce ...and that's it .... I don't see any complications here at all... and why would it affect on your immigration benefit at all when you are not getting it from your marriage i.e. your wife... you are filing petition on your own...your wife doesn't even come in picture ... u r not getting any benefit from her at all in immigration .... Its your employer that wants to sponsor you....Good luck...Pasha
