i have a greencard issued in 1984 , i havent been in the country for about 9 yrs, due to the uncertanty of whether i would be allowed back in on this greencard i came in on a 90 day waiver, i am now aware of the 2 yr re entry laws although i wasnt untill recenlty and have never applied for one . question is do the ins know if you have been out of the country or not , and if i go to mexico to lose the 90 day waiver could i return as an american resident who has been away on holiday to mexico with my card or would they know at the boarder that its not valid or is it still ?? i obviously would like to stay on the right side of the law ! and my reason for not returning in 9 yrs is due to health problems,im also now married to my girlfriend who is a legal resident, married in the u.s recently,, please any advice would be much appreiciated as my 90 days is almost up and cant afford to go home anyway!! ???

First, I just have a question. Your name is Michelle. Are you a female, married to a female? I am not trying to be sarcastic. My name is Michelle also, Miki is a nick name after my grandmother. It is kind of rare to find a man named Michelle unless he is French.

If you married your girlfriend and you are female, you have no immigration options based on marriage at this time.

If you are in a traditional marriage, you can file for adjustment of status since you came in legally.

You don't need to go to Mexico. It would just add more complications.

Best to apply for adjustment of status immediatly and not wait until you are out of status.
