I'm going for a Deferal Inspection for something that happened in 1966 and 1973 that latter was a felony where I spend 30 days in jail, since then I've had no trouble with law.This hapened when returning to the states after a short trip abroad, they took my passport and green card.

Could I be Deported for this?

When is your deferred inspection and what were the crimes for?

Under the INA (Immigration law) there are no statue of limitations regarding past crimes so yes, it is possible you could be deported (called removal now).

Really need more information and you might well want to get a good Immigration lawyers advice too. Most on this board are lay-lawyers, myself included.

My date is the 17 of this month, the offence was Malicious Mischief in 1966 and sentened two two day in jail adpay fine. In 1973 I was charged with burglary and sentendo 30 das in jail

I went to see one but as told to wait to see what hapens at the hearing

Thank you for your reply. I applied for my Social Security Benefits also, I'm 62 but because they are holding my Passport and Green card they can not process my Benefits and Pension. What would happened to my Benefits if I'm deported? If they want me to go, I will, although I have no relatives where I ws borned everyone is here in the States I Imigrated in 1964, I just want my Pasport and my Benefits. can you help me with your opinion?

Harald, you will be deported. Do not go to the deferred inspection. You can keep any private pension, but deported aliens cannot collect social security.

Thank you for your comments but I don't think I qualify for deportation based on the reply I received from Brit4064. Look under "Immigration consequences of convictions summary" very Interesting to read. I don't fall under any of the CIMT statue. I'm thinking positive tha's all I have right now!

Harald,

You must go to the deferred inspection. Be sure to bring a lawyer with you. You must prove that you have been hard working and out of trouble since 1973. Good luck.



The only thing un-American about America, is the USCIS.

I echo unique's post, you must go to the deferred inspection. Taking a lawyer with you is a good idea. If nothing else, he or she can act as a 3rd party witness. Good luck.

Thank you Brit I will be going, I haven't done anything wrong since those days in the 70's. Your attachement on your previous mail gave hope because I don't fall under the Grounds for Deportation based on my offenses and the ones descibed as reasons for removal r deportation, but... one never know.

I will Brit my appointment is on the 17th I'm hoping that my Court Records that I requested from the two different courts arrive on time, I paid their fees and all. What a nightmare, but you reply had given me a different perspective, thank you.

You are gone Harold you will be deported it is brutal but it is also true. Their was a law inacted by clinton in 90's now roboustly used since 9/11 which states any foreign national convicted in America for any offense no matter how long go is subject to deportation. It will be very hard for u to avoid it I guess that is what u get for not becoming an american citizen Harold. You should have taken it out 30 years ago u wouldnt be in this mess now.

You are absoludtly right about not becoming a citizen, there is no excuse only stupidity on my part. I just hope they get it over fast I don't want to sit at a detention center for months, I won't challenge the decission. I still love America I just don't like what it has become.

What is your original home country and yes Citizenship would have been a good thing to do. If you do get lucky and they allow you to stay, you might wanna get it ASAP.

I was borned in Chile, immigrated in 1964 with my entire immediate family they are all Americans including my children,( now grown )I applied for citzenship long ago was denied because I had ben working overseas and although I had a Reentry Permit , I broke continuity.
