let in one cheat, more will show up. These two cheats should have thought about this when they were lying to our embassy officials years ago...I doubt there is another culture on this planet that knows more about immigrating to the US than the Filipino culture....they knew only too well they were lying....it's not like they were 6 years old and didn't understand the simple questions asked of them....these two cut in line.....now it's time to send them to the back of the line.

I respectfully disagree, S12. These people have made positive contributions in the US. No matter what their visa problems were, they are good people. I would agree if they were using stolen identities and participating in other illicit activities, but that's not the case. I think they should be given a break.

so how about when some convict on the lam gets caught after being "absent" for 20 years from the can...and he has established a new life somewhere else, and is supposedly a 'good person'?? He's tossed back in the can...good person or not...and these two cheats should be given the boot....they don't even have to go jail...just back to the PI....

There are many what ifs in situations, S12 - but not of them apply to this one. The articles dislose their situation quite well. These folks have never neglected our laws - they've been law abiding people since their entry to the USA? So, why should a doctor and his wife be deported? Please refresh my memory!

S12, look, I have the same heritage as the Servanos, but nowhere along this thread have I ever justified their mistake.

And, hey, you're right, in cases such as this one, relevant law should be made to take its rightful course. Commensurate penalty for the misdeed. Lawful punishment for the guilty.

But wait, in our jurisprudence, there is a system of law called equity. Tracing its roots from the old English chancery, equity is a body of doctrines to broaden, supplement, or override the rigid interpretation of law, in the instant case, immigration law.

The Servano family has always been an outstanding member of the society, and removing them from the US will tip the balance of fairness both against them and the society that they serve.

Their counsel has already exhausted all available waivers and relief mechanisms - all denied. Their final order of removal has been handed down since before Christmas of last year. It's April 2008 and they're still here.

Just to give you a clue. It's the 'equity doctrine' that's at work here, and taking its normal course, no doubt.

You will for sure be against this, but, sorry, that's how the 'rule of law' in the US sometimes works. Just - as well as - kind.

to proud and and Rn...these two dirtbag liars jumped AHEAD of countless thousands by virtue of their fraud and misrepresentation....cheating others of opportunity while these two cheats racked up the cash....sorry...adios...back to the homeland and sit tight for a while and let other law-abiding types catch up, equity or not....I don't believe that 'equity" equals "bang out one or more Amcit brats" and then whine for a GC...

Okay, S12, you are entitled to your opinion. We'll just have to wait and see the outcome of this one. My hope is that DHS is overloaded with cases of real 'criminal' illegal aliens and will focus on those cases first! Big Grin

Ah well, ok, the couple indeed had four kids, but that's nowhere near aimed at the 'GC-purpose' that you'd want to imply. But that's more of a 'normal thing' for a 'normal couple' to have kids and raise a family. Oops! The husband has been a practicing primary care physician in an underserved area for about 15 years, while the wife contributed tremendously to the erstwhile sleepy business activity in a suburban town. Forget about their kids who are upstanding American students in school. I know, you don't care. For you, everything in this life revolves around 'immigration' and your 'bone-deep aversion' to it. 1. I believe in immigration and that it is an important thing for America
2. I blieve in obeying the law and punishing wrongdoers
3. I realize that the American immigration system makes it difficult, if not impossible, for honest good people to immigrate
4. I realize that it is impossible to deport 20 million illegal aliens that are here
5. I favor some reform that will allow people who have not committed ANY crimes (felonies, misdemeanors or marriage fraud) to adjust status by paying an appropriate fine; this should be very strict however and for a very limited time period and only allow people that are healthy and productive
6. I favor a new immigraton system that focuses on immigrants that will be positive for America; I would block any parents of people who are not going to have a long work life and just be burdens on society
7. I would seal up the borders once and for all
8. I would prohibit any moslem from coming in the country at all

I agree with you. Except for #8, the majority of Moslems are peace loving people.


I also think you should have to pay a fine. Aren't you responsible for importing a disingenuous alien? Did she not succeed in obtaining a green card? You should be fined $10,000 for stupidity.

I have been servicing this board for many years now answering posters questions, not just being here for social hour or thread blogs.

It would not be ethical of me if I held back on giving that poster information that could help him/her. Yes there was possible relief in the form of waiver for that situation. Of course it was fraud/misrepresentation. When it involves a marriage, uscis can be forgiving 4 benefit of the usc spouse. Do I approve of what was done?...Of course not as it makes me sick. But who am I to decide to withhold information that could legally help/overcome a bad situation. I dont roll like that, because i give 300% GENUINE advice to help overcome an immigration obstacle in order to achieve legal status if possible.


These Servanos are liars and cheaters... but I would treat them the same and give them the advice to have their children petition 4them to try to rectify the situation.
