YEAH!!!! Hubby was APPROVED! Our case was marriage based, hubby entered as an EWI from Mexico. We filed I-130 back in 2000, filed AOS in 2002 and approved 2004! As you can see it took exactly 4 years this month but we made it! Interview was a piece of cake when she saw how long we had been married and saw all 4 huge binders we had with us. I didn't even have to open but one of them to get 2003's taxes out and copies of childrens birth certificates. That was it, he was stamped and we were on our ways.
Our appointment was at 2:00, they didn't get to us until 3:45. The interview itself only took 15 minutes. Advice for you, take a book and LOTS of patience! They were calling lots of people ahead of us and taking people they had sent downstairs for things back when they got back with what they had to have. Thanks for the congrats. Good Luck to you guys when you have to go. We were actually in the waiting room 1 and a half hours before our appointment, as we had to drive 4 and half hours. I am soooo sick of driving, was a long trip in one day.

Did they ask you for your physical presence condition during the interview for your 245i to be approved? - any documents they looked over to see you were in the country since you filed?

You guys were so smart to have jumped at that chance that so many missed, as that amnesty 245I did finish on april 30, 2001. So glad you used opportunity to have adjusted.
My I130 was filed DEC 20, 2000... but I wasnt in the country, came to the US June, 2001. I am very skeptial about being eligible for 245i due "physical presence condition". Do you think I am eligible?

MO: We didn't have to show any of that, all she asked to see was taxes for the last three years. We originally filed I-130 in Sept. 2000, with an approval we were able to be grandfathered into the 245(i). The interviewer asked hubby if he had left while AOS app. was pending, he hasn't so he said of course not. Then she asked for copies of our childrens birth certificates and that was it. We had 4 HUGE binders full of everything so I think that helped.
4now- We didn't actually file during the 245(i) because we didn't understand exactly what is was. What really got us grandfathered in was the fact that we had sent I-130 in Sept. 2000 and it was approved in July 2001, and when no one could tell us where it was, we contacted a lawyer who explained it to us, so we got on the ball and filed. Great things come to those who wait and worry..lol.. I hope ALL of you guys have great things happen to you too!!!!! You ALL have been a big help!
