I am in the process of filming a documentary about the use of abuse charges to self petition by the immigrant spouse. So far I have been on 4 out-of-State filming shoots and have filmed about 20 interviews so far. One of the immigration attorneys I film interviewed told me she has represent 10-12 men that claimed to be abused by their American wives. 10 have been approved and two are still in the process.

What I would like to do is film an interview with an American woman who has been accused of abuse. Personally I feel allot of these abuse cases are fraudulant. So if you are or know of an American woman who would like to speak with me send me a PM. I would much appreciate it.

Ha ha; sounds like you got a winner of a lawyer there ! Of course if she told you that, she would be violating the ABA ethics code and be disbarred. The abuse waiver is definitely "abused". In my personalexperience, it backfired on my accuser big time.I would give you her number but she's already in removal proceedings.
The thing a victim of marriage fraud needs to do is to get judgements of marriage fraud in the record somehow. That helps a lot.

You know, I am not surprised that men claim that too. I have experienced abuse due to immigration issues for many years and now think that it would make just as good a control vehicle for a woman as it would for a man. So, I believe that abuse is an issue in these cases, because it is a very easy way to control/abuse someone with immigration.

Like, you either do what I say, or I am not going to file for you!!!

Too bad that the last poster decided to pull her post. We need people that have been victimised like her to stand up and be heard.

I was going to say and I will that your ex-husband will not be deported unless he commits a felony and even then... Also he will be on the fast track to US citizenship. Just a 3 year wait after he gets his 10 year Perminent Residency Card. Which by the way will be issued to him instead of the 2 year conditional card. Also your name will be placed in a USCIS (INS) file and national data base as a "Abuser". If any of this offends and you want to something about it you can contact me. I can give you a list of references of other men and womnen I have worked with on their stories.

Hey Max, Just wanted to respond to your post ... I pulled my post because I felt it needed to be edited. What I DID post didn't tell anything close to the whole story, but then it's QUITE lengthy & I don't think all of you want to hear the whole nine-yards!! I will repost it in the next day or so. I DO appreciate and thank you for your post... nice to see it may be important to others!

I do have a question though... Is there a good enough reason that a "habitual drunk (+drugs + a MVAccident) driver" (5+ in 3 years) should be permitted to stay here?? I sure don't think so. He WILL seriously hurt or kill someone one day...mark my words! Not to mention that he's stolen from me AND my folks...attempted to extort & blackmail me (to my attorney...And, IN writing)...filed a fraudulent claim against my insurance policy (which he added HIS name to, prior to submitting the claim)! ...there you go ~ just a few issues which make me believe he SHOULDN'T BE GRANTED STATUS ! Am I wrong??

At this point, I'm very disgusted! I wrote to the CIS/INS a while back ...withdrew my petition, and, and ...I really don't think they give a **** !

He's got it ALL figured out ...even became a MINISTER ~ (ALSO one reason why an immigrant might be able to stay)! He doesn't realize that I know where he's living now. Since '02 he's been "in hiding" ...ok, from me ~ cause I think he KNOWS I'll do everything in my power to have him deported IF at all possible...he's now remarried & living in the mid-west, so I'm not even sure if he will have to deal with Vermont anymore. ??

Guess I don't have to say a whole lot more @ my next post! lol Wink ...but I will fill in some missing blanks, I'm sure.

Take a look at the drunk driving provisions of STRIVE. I don't really like the act in general, makes little sense to me, but the drunk driving provisions it contains are very well designed. They combine precedent case law with principles of fairness, equity and target serial, habitual drunk drivers in general.

The vast majority (80-90%) of abuse in the world is committed by women. Its funny that they even have a "Violence Against Women's Act" but there is no "Violence Against Men's Act" even though men are victims of ciolence 90 % + of the time.

men are abused, the days are gone that the little missy is sitting in the kitchen!!

But .. as koller said how many women have not been able to adjust status because so called hubby is holding it ransom!!! In my opinion and its not worth a monkeys toss, more women are abused than men. Although of course there are some men out there, those that thinik they are owed something for bringing said immigrant to this country.

I haven't much time to write now but I would like to say what my objective is with my documentary. It is to show that when the USCIS does not hear both sides of the story it often makes serious mistakes. That this one side process even encourages fraud and attracts a criminal element into the picture. I know all the arguments for why only the accuser should be heard. I don't buy them on the grounds that if our legal system operated this was and abolished the adversarial process there would be utter chaos. The reason the USCIS can get away with it is because it is on a relatively small scale ( only only 9500 abuse petitions filed last year) and the general public's dislike of men marrying foreign women as in the slur "mail order brides".

My documentary is more than half finished with regard to the interviews. I am editing the first interview for the begnning of the film. There is some amazing stories out there that need to be told.

About who is abused more.

It maybe about even. Who really knows when abuse can be psychological, verbal etc.? I would say that men are more capable inflicting serious physical abuse but I have heard that women can overcome their disadvantage when they resort to the use of objects to do their damage.

It is a uncomfortable subject and I can see why most people leave it up to the "experts" to make the decisions. "Most people" would include our politicians who leave it up to their staffers to write these abuse laws. I usually try to avoid the politics of this issue though.

you dont think for one moment that USCIS doesnt know what ur saying. Do u honestly believe for one moment that just because a person is abused that its a free ticket to a green card. BELIEVE ME IT IS NOT!!!! Also interview the people that are now in limbo because they gave up all their worldly possessions and gave up good jobs to come and live with so called loving spouse be it husband or wife! They cant leave because they have nothing to go to and they cant stay because the red tape makes the process **** hard!!! Your talking about men and their mail order brides, ur a bit behind the times. A lot of marriage petitions are from people who have met hubby/wife online! Not actually going to the cattle markets of eastern europe and asia by the bus load which is now outdated. And u have to remember after 3 years of getting a contidional gc most can get citizenship. So ask urself why many dont even get to the stage of filing for AOS? U dont think the immigration service is not aware of the cheats and scams going on. You obviously havent read the interview questions that can be asked.

Personally I think ur fooling urself that people are getting thru the back door because they are screaming "abuse" !! Maybe u should interview someone that has been here for years and hubby/wife blackmailed and threatened and abused spouse with the threat of deportation if they leave them. And then when they do leave find that correspondence has been with held or that applications have never been filed or that they are unable to work because they are now in the illegal catagory! 9500 abuse petitions that they know about , how many stay in an abused relationship for fear of the immigration system? You obviously have a purpose but u could have put it to more use than just the negative for the immigrant.

Ntfd3, I am well aware of abusive and controling US citizen spouses. In my opinion men who use AOS withholding tactics should be sent to jail. I would say the same for women who use prvable false abuse claims. I also know immigration knows the flaws in their system. I have spoken to them and many of them feel that their hands have been tied as far as using common sense by the CFR and VAWA laws.

I could broaden what I am doing as you suggested however my efforts would be dilluted. Really a series of documentaries need to be made. New people coming into this process should know about the things you and I are writing about here.

In regards "mail order brides". I am afraid the general public would not distinguish the difference if one met his/her spouse on line or via a marriage agency, whether it is match.com or russianwomen.com. It is the same difference to them.

No I don't think I am fooling myself about people using the back door by claiming abuse. I have documented proof in many forms of this type of fraud. It is my intention to show this so that all but the most dogmatic will see that this condition does exist.

Max, do you think anybody serious is going to believe a one sided documentary??
I suggest you take a Film 101 course. It will tell you how to make a believable credible documentary. You may stress the abuse of women in particular, but a witch hunt documentary won't be taken seriously.

as for beutiful mail order brides how ficcle. Are u so interested in outward beauty that u have no idea what the inside is like!!!! i am not disputing that there are many beautiful eastern brides out there.. But did u know they go to special schools to make themselves more attractive for the market such as this? Did u know that they put all their savings into the scheme of gettting a western man, not just usc but all western europe . Its a scheme to get their family to a better living standard most of the time. Some i agree to fall happily ever after in love, however its a business agreement for the majority.

It is more toned down than your post to me. Actually filmmakers make documentaries for the various women's advocate groups. Do you think they are balanced and show the other side of men being falsely accused and set up by the local women's shelters? Yes it's a tough sell because people have been so conditioned by society through the establishment media to simplistic biased thinking.

A well know documentary filmmaker Barry Hamp wrote that it is impossible to make a documntary without some bias. The object is to keep the "some" limited. Just so you know I have a number of women and immigrants helping with this.

I have been deeply involved with this issue for more than 4 years now. I know that there are persons and perhaps iperson you are one of them that want only one side, the angled journalism side to be known? To get to the truth both sides have to be presented. This of course is something that those that benefit from the bias do not want. So iperson what is your background?
