I am currently going through a divorce with my wife (American) who being with for 6 years has failed. My divorce is only a few weeks out before it is final.

My girl friend and I met back in November 2006 and we have been in love since. She is from Brazil and has been here for almost two years. (Not sure what type of visa she is here on) Anyhow, I am wanting to marry her as soon as my divorce is final, and was wondering if there is any thing I can do to get the ball rolling (engagement/citizenship, etc) while I am still pending my divorce.

Any steps that I can take would be appreciated, if I simply cannot move forward until my divorce if final, then just say so.

This is not a fake marriage, she is not using me, she was here for 1.5 years before she met me and she could have done the fake marriage way before that.

So needless to say, do not flame me. Just need some insight as I am learning about this on my own before I start spending any money.

First, you CAN'T enter into a new marriage unless and until the dissolution of your previous one(s). Second, before anyone can help you here you must give exact details of your and your gf's CURRENT immigration status. Third, the burden of proof of a good faith marriage is decided during the immigration process, not now.

Thanks, I already stated I would have to wait to my divorce is finished.

What is the best way to obtain her immigration status/visa status?

I know this too, I was mentioning this for the naysayers on this website.

No need to be bitter, she has a Visa to 2009 so not sure what the whole "Visa Cheat" comes from.

Adrnalnrsh, just ignore them, they like to get people riled up.

I'm sure you'd have to wait until your divorce is finalized, then you should be able to marry her and adjust her status to a permanent resident.

Wow, must not be any moderators on this board.

Sorry, but I was born in and served for your country, so this makes it my country too.

As for my case, its not PHONY!


Oh and lets not forget, its guys like me who fight for our country to give us to the freedom to marry whomever we want. So if you are truly sick of illegals, then get off this board and do something about it. Otherwise shut the hell up!
