I have a situational question/fact pattern (for which I already know the answer). I am curious to see what others know.

Fact Pattern:An illegal alien marries an American. The illegal alien uses a fictitious name to marry the American and then abandons the American citizen with whom he/she has a child. The alien never pays child support nor assists in raising the child.

Years later the now legal alien marries someone from her/his country.

Years later the now legal alien applies for U.S. citizenship. On the application N-400, Part I, Section A, the alien puts his/her real name. On Part I, Section C, the alien omits the fake name he/she used to marry the American citizen.

The alien omits that he/she is married to an American citizen.

The alien omits that he/she has a child with the American citizen.

The alien omits that he/she has never paid child support.

On Part 8, Section F, the alien says that he/she has never been married before.

On Part 10, Section D (Good Moral Character), question 15, the alien marks "no" to the question "have you ever committed a crime or offense for which you were not arrested" -- while married to two people at the same time.

On question 22d, the alien marks "no" to the question "been married to more than one person at the same time?"

On question 22g, the alien marks "no" to the question "failed to support your dependents or to pay alimony?"

On question 23, the alien says "no" to the question "have you ever given false or misleading information to any U.S. government official while applying for any immigration benefit or to prevent deportation, exclusion or removal?"

On question 24, the alien says "no" to the question "have you ever lied to any U.S. government official to gain entry or admission into the United States?"

While the situation stated above is reminiscent of my case, please do not answer based on what you know about my case. Please answer based only on the situation itself. And remember, I do not give a d..a..m..n about your personal opinion -- only your opinion based on your knowledge of immigration law. If you are a foreigner who does not know immigration law (really?), ask your former immigration attorney.

Question 3: Is being married to two people at the same time a crime for purposes of naturalization (i.e. "moral turpitude")?

Question 5: Is lying to the federal government a crime for purposes of naturalization?
Question 6: Is writing false or misleading information on a federal application a crime for the purposes of naturalization?
Question 7: Is marrying an American citizen for the sole purpose of obtain a green card illegal?

Part II -- Immigrants?Question 8: Are you an immigrant?

Question 9: If yes, how did you obtain your green card:

If you chose to answer these questions, I will forward your responses to the United States Citizenship and Immigration Services and to the U.S. Department of Homeland Security. I believe the United States government should know how people think.

Cheryl. Uscis doesn't care what we think. They have laws to go by and our opinion is irrelevant. Of course if a person lies the citizenship can be revoked. But, the question is this. Do you know how the questions were answered? Are you entitled to view that document? Do you know for a fact he is a USC? If he is, is it such a good idea trying to have it revoked given the circumstances? Are you sure you are even married to him? He could have divorced you while in Nigeria for all you know. If he is Muslim or any number of other religions he may be completely innocent of bigamy in his country. I would assume a Nigerian senator can change their religion to fit the need any time they want.

Instead of wasting your time making up these useless surveys put some effort into making a better life for yourself and your daughter.

I wish to post another situational question/fact pattern for your consideration. I make the same request that I made in my last post: Although the fact pattern is identical to the fact pattern I presented to this discussion board concerning Senator Uzamere, please do not respond based on your knowledge (or lack thereof) of my personal situation. Please respond based on the situation presented in the fact pattern alone:

During the course of an immigration attorney business day, he/she happens upon an illegal immigrant who walks in with an American citizen. When it is the illegal immigrant's turn to speak with the immigration attorney, he/she tells the attorney that the American citizen is his/her spouse and that he/she needs an attorney to apply for permanent residence based on marriage. After the illegal immigrant has consulted with the attorney, retained his/her services and paid the requisite fee, the attorney asks the illegal immigrant to present all of his/her documentation pertinent to applying for permanent legal residence. During this time the immigration attorney never engages in any discussion with the American citizen other than to give him/her the I-130 form to sign.

The illegal immigrant presents his/her passport and other forms of identification from his/her country. All the identification from his/her country has the same name, same birthday and same parents' names. However, the marriage license and marriage certificate do not have the same name, same birthday or same parents' name that the illegal immigrant's foreign identification has -- nor does the illegal immigrant have any identification from his/her country that contains the information that is listed on the marriage certificate and marriage license.

What should the immigration attorney do?

I'll tell you what: While interested cyberposters (cyber-jackasses included) attempt to enlist the assistance of an immigration practitioner, I will call the United States Department of Citizenship and Immigration Services at 1-800-375-5283. For those of you are too stupid (or too ashamed) to call, you can alway rely on JermCool to give you information. I hear that contacted Allen Kaye so I guess he can call him again and ask him the same question.

It's now 11:20 a.m., Sunday. The skies in Brooklyn are overcast and there's the sound of thunder roiling through the clouds. The rain hits my windows with a persistent yet strangely soothing beat. I sit quietly, comfortably happy in the knowledge that the day of justice for the former green-card-marriage-scamming, child-abandoning, bigamist and identity fraudster Nigerian Senator Ehigie Edobor Uzamere are nigh.

I try to surpress a giggle as I imagine the iggy-binners, trapped liked terrified, hungry rats, scampering to and fro to find crumbs of failure that they think will drop from my plate. But there are none. And like the cybercowards they are, they are too gutless to take down the telephone number on my website and call me.

The iggy-binners scheme and plot amongst themselves, sadistically "happy" that I have a mental disability or some other "character flaw" that they can point out -- when it is clear that they themselves have a more serious character flaw. Iggy-binners like "-ig-jeramos" make defamatory statements about me, pretending to be happy as they temporarily bask in their delusions of grandeur -- but they are really foreigners who are p..i..s..s..e..d off that one among their ranks is having the legal and judicial c..r..a..p beat out of them by -- oh the humanity! -- a non-foreign black American.

The iggy-binners' lives are worthless and without value unless they read words of unchallenged and unchallengeable wisdom I might impart. In the USA it is not illegal for someone to use an alias name. As long as they are representing themselves, and not using the name to defraud anybody.

The question is, did he defraud you? You clearly loved him, or else you would not have married him, right? You say he got you pregnant, then left. Were you pregnant before you got married, or did that happen during the one day he stayed after marriage?

Just out of curiosity, why were you so attracted to him? I saw his photo and wouldn't have guessed that he'd be your type.

Unique, in case you are in the iggy bin, yes she was pregnant before marriage. She got pregnant straight away whilst dating. Her boyfriend at the time (now husband) and her future brother in law tried to convince her to have a termination, but she refused. For some reason he married her, and on the day of the marriage, he took her and his now step son around to her parents, left them there, said he was going to Nigeria I believe and never returned (to her at least).

And ask some of your foreign friends how many of them got soaked by immigration attorneys, thinking that they were going to get legal residence but all they got was ripped off instead?

Many immigration attorneys are only loyal to their wallets -- not to you and not to the U.S. government. That is why I started the movement to abolish green card sponsorship through marriage. Once immigration attorneys' major source of income dries up, they will be more amenable to bargaining with American citizens.
