I am a USC, and have been all my life. I own a computer company based out of houston texas, and I work very hard. To make a long story short, I am falling in love with one of my clients, and well, she is an illegal alien. She is honduran and italian, and she has been in america for three years on may 16. I am willing to marry her, and stay here, or move to honduras with her, but I would rather stay here as I have my Job that I started little over a year ago. She works, but under the table, and she has a car but no license and no insurance. Someone tell me please what the best way to go about making her a citizen is as I am lost. I thought that I knew my law, but reading some of these posts has proven to me that I know **** about immigration laws. She did get served with a court notice when she was caught coming over here, but she never went, someone explain to me the best thing to do please

John, she'd probably have to become a permanent resident before a Citizen. Since she's here illegally, she would probably have to go back to honduras at one point for a visa interview there. She would most likely be denied because of the illegal presence and have to file an I-601 waiver if she qualififes for that. I don't know all the speceifics of your case though and am by no means an expert.

I HIGHLY recommend that you go to immigrate2us.net and start posting there. You'll get a TON of help without having all the negativity from people who don't like illegals.

Forget about it IF you want to avoid ALL KINDS OF FUTURE TROUBLES, let alone that phony marriage you are thinking about. That woman was already served with an order and she decided to wipe her black and indian a/s/s/ with it. DON'T DO IT MAN, DON'T GET INVOLVED WITH THAT CRIMINAL ILLEGAL. And what do you know about Honduras anyway? check it out for yourself.

If she's here illegally (entering without inspection), to legalize her status, she eventually will have to go home.
The procedure and timing can be found at:

The waiver process is discussed in great length over there.

If she entered the US legally and overstayed her visa, then you can follow the normal processing to apply for permanent residency as outline in

under the immigration through a family member section.

Yes, please clarify her entry. I am wondering if there is a past removal order and a subsequent illegal reentry or if there is a removal order issued in abstentia (in her absence). If you have her alien number(s), you can call the EOIR docket automated system and find out hearing information. If so, you cannot proceed. You need a consulation with a local immigration attorney. Make this sound investment. Going home can trigger unlawful presence, depending on the situation. I wouldn't rely on immigration advice via this forum hosting a spectrum of motives.

Let me correct myself, if there is an abstentia, you have some opportunity. If there is a subsequent illegal rentry following prior removal, you cannot proceed.

There is one and very simple way to get her legalized - just marry her. I don't see any problem here. I am sure you are financially sound, love is in the air, she is probably a stunner- go for it!

here is the deal,no one can become a citizen just like that.In order to become United State Citizen aka an American,you have to live and be a legal Permament Resident of the United States of 5 full years (having a green card),without any crimes,then you can apply to be an american and pass the test etc,after 5 years!

If married,Only 3 years.

Your problem with her will be,and I am fimiliar with the law.She was did get cought by law before and was served and got a notice to leave.
Therefore,by getting married to her won't make it easy at all,she can and will still get deported,even if you guys gte married.Just the fact alone that she not only came here illegally but also was cought and asked by the court of law,to leave,she never did.

And you have to rezlize the other problem.You are from Texas (my old state) ;-) and Texas has very hard laws about driving without insurance and no drivers license...she should be carefull about getting pulled over.

I would suggest to you,to hire an attorney and start making process with an attorney to take the legal and right steps.
If you indeed love her and want the best outcome without mistakes,go for it with an attorney...get some professional advice.

You are soo wrong! I had a girlfriend, who walked the border (eastern european, was married to mexicano,while he was going to school in europe, family did not exept her)met american men, PAID $500 FINE for crossing,never home and got her green card.The other thing - here are a lot of "wanna be lawyers" or law students, who don't know jack and give advices against human logic.

Again, if she's EWI/entered illegaly, marriage to an USC won't absolve from having to exit the USA and adjust from another country (marriage is still necessary for legalization though). If she's entered with a valid visa, then yes, marriage and pursuance of AOS is the way to go.

Here's the problem.
At the minimum, your inital petition will be denied by USCIS. To overcome the 10 year bar, then your girlfriend will be forced to go back to Honduras to file I-601 waiver in embassy. Because she has an order of deportation, whether she is even eligible to file I-601 waiver depends on her situation, which none of us can know fron little info you provided.

If she is indeed eligible for waiver, then it is totally up to immigration officals in consulate to grant her waiver or not based on your explanation of why a waiver should be provided for her. If a waiver is indeed granted, then she will have to go back to embassy to for a interview to get the entry visa. Eventually, once she is let in US, then both of you will have to file for her adjustment of status and wait for another interview at a USCIS office for a green card interview. It is a long drawn out process and your waiver(if eligible) will be difficult to get accepted , but it may be your best shot.

seems no one is answering the question. HOW DID SHE ENTER USA? IF IT was legal then she can adjust status if it was illegally she needs to go home and apply for a K1 there.

I had deportation order in 1990, never went back home, then ger my PR in 2005.Why would she, if US citizen's wife will have to go to Honduras? Few of you, "wanna be lawyers" so not in touch with what is really going on in reality, that I don't understand, why give
advice? May be you just trying to sell services of this web site and scare people?
