Thank you Mike2007 for your support, and you have made some good points, I agree with you, regarding illegal aliens who cross the border and want to become legal and work and build a life over here with there family, but not the criminals, I wonder how many people realise, that without the illegal Aliens in California, they would not have fruit and veg in the supermakets and Grocery stores, as Explora said earlier in this dicussion, the supposedly "upstanding American Citizen" like Someone12 would find it degrading to work in the fields.
Although Mike, I must correct you on something, I have not worked, I wouldn't have the guts to work illegally, My Husband and I have been worried enough with me being out of Status.

I think it was Hudson who pointed out the issue with immigration laws being strange. He used the word 'vase', not sure if he meant vague or some another term. Brings to mind something else. We need to remember that a lot of ESL people read theses posts so we should keep that in mind and minimize the use of $20.00 words and phrases.
The immigration laws are the only ones to my knowledge that will allow a person to suffer little or no consequence for breaking them. Provided the correct forms are filled out with the right terminology or *** story, take your pick. S12 worked in that arena and probably saw a lot of people who frauded their way through the system. Used every deceitful trick the lawyer could find for them to gain the GC. He's right. Lawyers for the most part are bottom feeders. Unfortunately, sometimes we need them to get the job done. Most of us don't have the time to take immigration law classes to learn what he knows so we are at the mercy of those vultures.
Upsetting is seeing someone getting away with breaking the law, especially if its someone who isn't even from here. Call it nationalistic pride. Can a person get a waiver for any other federal crime? I doubt it. Is it really even a crime? I don't think it is. On my fianc'es papers she is referred to as the respondent, not defendant. Respondent is used for civil issues and defendant for criminal. Even on lesser crimes the primary reason time off or suspended sentences are given is to lighten the population load of the prisons. So it stands to reason it would p i s s a person off when they see enough of it.
The real question is why does the immigration legal system have the number of loopholes it has. The gov on one hand says it wants to stop illegals from running across the border. We have the military, national guard, and millions of people willing to volunteer to stop it. Why hasn't it happened? Cheap labor, Americans don't want the immigrant jobs, too many welfare moms, too many fat people, etc. What happened 40 years ago. Who did the jobs then? None of those arguments make much sense.
I'm in this boat myself. When my fiancee first got into trouble I was surprised at how serious it was. She went to jail for 9 days. It had the appearance of being serious. I was told of 10 year bans and 2 year return rules. I saw it in black and white and assumed that was it. The show is over, your going back home. Later on I found out about waivers to dodge the ban bullet. Honestly, my first impression was why have these laws if there is a waiver for all of them?
At days end we still need to respect the laws. If the waiver is denied or our hopes are squashed we must abide by it. We can't expect the laws to be upheld by others when its to our benefit if we're not willing to uphold it when its not.
That also means not trying to shut someone up because we don't like what they have to say. I didn't like listening to his tirade when it was directed at me. But, sometimes its not such a bad thing to here an opinion that is far from our own. The first amendment is what rang his bell.

However, Mr. Powell, although a brilliant orator, was wrong when it came to opposing the anti-discrimination laws in 1965. That was the issue when he arose to fame. And saying "Powell was right" is to give "a certificate of respectability to white racist views which otherwise decent people were ashamed to acknowledge."

Let me give you a brief introduction of my personal work experience. When I worked in compliance, auditing, I only saw two types of taxpayers: fraudsters and cheaters. I have seen more fraud than you can possibly imagine ranging from EIC to small business fraud all under the umbrella of what might be considered legitimate. And how much do you trust your accountant doing the filing the taxes correctly and accurately. If it was not done, then you were either on of those two categories. Kinda of disheartening to know that an employee of the government who only think of these two possibilities, is it? You would even say it probably violated your constitutional rights? But hey, its the IRS. It is the US Government. You are disrespecting the laws of your own native country. Then came RRA '98 along with the taxpayer "bill or rights" and all was well, sort of with still cheating and defrauding the government going on by Arthur Anderson Accounting Firm, KPMG, Price Waterhouse Coopers, etc.
So, what does this have to do with 12 and immigration law? S12 is generalizing the same way seeing every potential immigrant as fraudsters unless they adhere to his particular, extremely restrictive rhetoric of what immigration law should be. And history is on his side starting with the 1882 Chinese Exclusion Act, where illegal alien was officially defined, through the current "CIR bill." We may think someone is "violating the law" but we don't know all the facts. We tend to believe the USC spouse who cries "fraud," "immigration chess game," etc before we look at the other story. We see people who accidentally violate the law or are faced with circumstances that the current immigration law does not know how to adjust the situation, like your girlfriend for instance, Davdah. There are very few waivers that can be applied and there is no general rule on how USCIS, BIA, or any other body would rule. That is why it is so important for judicial review to be implemented in the immigration law. We have it for most other legal statues, but not for immigration law.

having worked as a paralegal in an immigration law firm for several years, I can attest to the fact (at least regarding the ****s that came through the door) that fraud was rampant, that the attorney was glad to aid and abet almost any kind of krap to try to get somebody an immigration benefit. We saw sham marriages by the carload, jagoffs whose qualifications for an H1B were non-existent, but who submitted doctored papers to cover his lack of education ... phony waiver requests for $hitbirds like Jake who claim to have had the intention of returning to their own country, but somehow "forgot" to do so...and then ran out to marry a village idiot. The one thing I learned was that this hor$e$hit about 'changing one's mind' always seemed to take place 5 minutes after baggage claim....what an amazing coincidence! I say (as I have said repeatedly to my legislators) eliminate ALL waivers, make every immigrant law violater (i.e. illegal aliens) pay the FULL price for their lack of respect for our laws....no exceptions under any circumstance.....what would be the likely result? Sham marriages would dry up....our country would have order restored and immigration attorneys might actually have to do some real work for a change....and at worst, a few thousand scumbags remain outside our borders....so what?

Once again - NOT TRUE. According to IMBRA, American men are PRESUMED to be abusers in the eyes of the law. Not one of these frausters have renounced their homelands and expressed absolute and unconditional support and loyalty for the U.S. They hate America so why should we care?

There have been a lot of letters on the illegal immigrant problem. Some are comical and others are blatantly hateful. That said, it is very ironic that Oklahoma is celebrating its statehood this year, because many of the people who helped establish this state were more illegal than any illegal now.
But, we have a less de-humanizing name for these people. We call them, with pride, Sooners. The Sooners were people who claimed their stake of land before the actual legal land runs started. They stole land (often from Indians) and they still live on this land today. They were and still are illegals.
I wonder if those in Tulsa who rail against Mexican immigrants are also railing against Sooners. Sifting through all the editorial letters, I see none of them doing that. I see people calling Mexican immigrants terrorists or illegals, and then telling them to go home. But why aren't those with ancestors who are Sooners deported and branded as illegals?
Of course, doing this would liquidate much of Oklahoma, but it would get rid of the ills of all illegal immigration. I cannot see how any anti-illegal immigrant Sooner could disagree.
But, such an outrageous idea as this only proves a big point: When hypocritical Sooners and their friends call Mexican people illegals with disdain and tell them to go home, it does not help anyone. In fact, it exacerbates the problem. It simplifies the issue and gets us nowhere.
