local ins office only accepts AOS by mail, but EAD in person.

hubby is visa over stay and also has to go to special registration by the 21st.

since they accept walk in EAD's, can you submit AOS in person with EAD before the deadline?

if yes, can you turn around and say ok, now i want to register?

i am scared if they see he is a special registrant on his EAD application, they will issue NTA, or does he have the right to come to special registration on his own "before the deadline"? thankyou

Your husband will probably be arrested if he goes to Special Registration interview.

I think there minimal to no chance of him getting detained or at least thats how I feel with my experience of going for registration, provided he takes with him the marriage license and FedEx reciept for AOS that he should file immediately without waisting any time. It takes INS some 6-8 weeks to send the Reciept Notices and he'll probably not recieve before FEB 21. The FedEx reciept and marriage license should be good enough. I am not an attorney and say this from my personal experience and research over these past few weeks.

I forgot to point out that he may also be aware that he has no prior conviction on his record or any other criminal record that may raise red flags on the INS data base. I would suggest to consult an attorney before deciding to go in that case. Goodluck.

we sent it 3 days ago with internet signature receipt. i have signature receipt printed out.i have all original document's, marriage license, sealed medical (local office does not want till they give further instructions). and exact copy of AOS in a replica folder, copies of checks, etc.

i still think they will give NTA cause it is not officially accepted and pending yet. still i feel so much better. i don't think you can AOS once NTA is issued? if the don't give him NTA, what will they do (if he is ok?) thanks
