Unfortunately it depends on what State you are in and your circumstances.
There is no set rule or timeline. It could be as quick as a month to years.

Cost could be little to mega bucks. All depends on lawyers, how long marriage, kids involved and whether contested divorce or not.

What State are you in, I then can give you a link to your State laws.

This isn't a divorce forum, but I guess there may be some immigration related issues? If so, do you need information for that?

It would depend on your grounds for divorce, and the state you live in or got married in.

If you both want to get off cheap it can be done without lawyers. As long as you both agree to the terms and it is fair. The judge can toss it it out if it appears too one sided. It doesn't have to be where each grain of rice is equally divided, but something reasonable and it should not be viewed as a punitive measure either. Not like, you have to give up your car because you called her fat or something.


Some of it might depend on how long you were married. There is the issue of so-called support a person might be entitled to. God, I hate that word. A democrat word if there ever was one. If the marriage was short and neither of you make a lot and both are working you should be able to make it a walk away divorce.

Walk away is where both of you walk away without taking anything on-going from the other person.

But there is a ball and chain the sponsor carries no matter what the result of the divorce. It's called the I-864 obligatory support. If you were the sponsor you are required to support, if needed, the immigrant until one of a few things happen. Divorce doesn't cancel it either. Minimum sentence is up until the person obtains citizenship.

If both of you have jobs and neither are far and away earning more than the other it shouldn't matter. If the immigrant isn't working you could be held liable for any means tested benefits received by the immigrant.

The best thing to do is try and keep things fair, but not punitive, and get it done quickly.

How long have you been in Wisconsin? Is your spouse in VA or with you in Winsconsin?

There maybe jurisdiction on which State you can file the divorce in you see.

For example if you both lived in VA and only you recently moved to WI, then the divorce has to be filed in VA. There is a minimum length of time that you have to reside in a State before you can file the divorce from your end, if you are not in same State as wife.

Some States require 1yr separation even before filing for divorce. Very complicated.

Hi MakeITright, are you from Virginia?
We are agreeing to divorce. How much are the court fees, and is separation necessary??? We want to get divorced as soon as posssible. And what proof is that?

Proof as to Living apart for 1 year, proof in your word NO cohabitation has taken place. Agreement that each of you has no intention nor possability of mending/fixing the marriage. sepperate addresses!!! letters, Bills, Mail, Confirming this.

Note: As in many other states, In Va. There is no such thing as LEGAL SEPPERATION! Only Proof of Living apart for 1 year to Obtain divorce.
Commonwealth States Have the ability and Power to Alter Some Rules and Laws to Follow the commonwealth.

i am in Wi, he is in Va. He is my husband, and we separated about 1 month ago I moved to Wisconsin.
How long will it take. I think he will file in VA. and what are the costs exactly?

1 yr separation it looks like. You need to read up on that link I gave you, it gives facts and laws.

Costs can be little if you both agree. In fact you don't even need lawyers if its very simple and both agree to everything.

Are you or your husband from France? If that is why you are called Frenchy?

Are there any immigration issues that you are worried about? Or is that all ok?
