Comment: EB5 RC Program Extension
Congress is currently in recess. Just about one legislative week remains to complete the appropriations bill. 2 to 3 votes are needed for enacting appropriations legislation, either as a reconciliation bill or thru the defense appropriations bill. Since Senate rules require lengthy debate, one legislative week is barely enough for the necessary 2 to 3 votes. To make this happen, both legislative strategy and actual language need to be ready by April 23rd - it would then be tight but doable.
However, there is a problem. Recent credible reports point, firstly, to a renewed push to revive the failed health care legislation, and secondly, to a desire by the White House to include language cutting off federal funding to sanctuary cities. Both these measures would doom the bill with Democrats and would have to rely exclusively on Republican votes for passage. This leaves very little maneuvering space or time for achieving consensus on ancillary items, such as Regional Center extension. Given that the appropriations bill has many weighty issues like taxes and core government spending, all the maneuvering oxygen will be taken up by those issues. While there are persistent rumors that compromise language acceptable to most EB5 stakeholders has been worked out, we remain skeptical that in the current atmosphere in DC, EB5 can command the attention needed for enactment of compromise language. We believe the Regional Center program will likely be reauthorized unaltered through September 2017.
