  • News: USCIS Announces Adjustment of Status Filing Dates for October 2016

    Adjustment of Status Filing Charts from the Visa Bulletin

    Are you seeking to adjust your status and become a U.S. permanent resident under a family-sponsored or employment-based preference immigrant visa? If you have not yet had a relative or employer file an immigrant visa petition on your behalf, please learn more about the Adjustment of Status Filing Process. If you already have a petition filed or approved on your behalf, you may have to wait for an available visa in your category (if applicable) before you can file your Form I-485, Application to Register Permanent Residence or Adjust Status.

    If USCIS determines that there are more immigrant visas available for a fiscal year than there are known applicants for such visas, we will state on this page that you may use the Dates for Filing Visa Applications chart. Otherwise, we will indicate on this page that you must use the Application Final Action Dates chart to determine when you may file your adjustment of status application.

    We anticipate designating one of the two charts each month and linking to the relevant chart below within one week of DOS’ publication of the Visa Bulletin.

    Current Month’s Adjustment of Status Filing Charts

    For Family-Sponsored Filings:
    You must use the Final Action Dates chart in the Department of State Visa Bulletin forSeptember 2016.

    For Employment-Based Filings:
    You must use the Final Action Dates chart in the Department of State Visa Bulletin forSeptember 2016.

    Next Month's Adjustment of Status Filing Charts

    For Family-Sponsored Filings:
    You must use the Dates for Filing Family-Sponsored Visa Applications chart in the Department of State Visa Bulletin for October 2016.

    For Employment-Based Filings:
    You must use the Dates for Filing of Employment Based Visa Applications chart in the Department of State Visa Bulletin for October 2016.

    For Expiring Employment Visa Categories:

    You must use the Final Action Dates chart in the Department of State Visa Bulletin forOctober 2016. Please see more explanation below.

    SCHEDULED EXPIRATION OF TWO EMPLOYMENT VISA CATEGORIES

    Employment Fourth Preference Certain Religious Workers (SR):

    Pursuant to Section 573 of the Consolidated Appropriations Act, 2016 (Public Law 114-113), the non-minister special immigrant program expires on September 30, 2016. USCIS may not accept or approve SR adjustment of status cases after midnight September 29, 2016. As such for purposes of determining when an SR adjustment of status application may be filed, USCIS is listing this category as “Unavailable” for October. If there is legislative action extending this category for FY-2017, USCIS will update this chart and begin accepting and adjudicating SR adjustment of status cases accordingly.

    Employment Fifth Preference Categories (I5 and R5):

    Pursuant to Section 575 of the Consolidated Appropriations Act, 2016 (Public Law 114-113) the immigrant investor program expires on the close of business on September 30, 2016. USCIS may not accept or approve I5 and R5 adjustment of status cases after September 30, 2016. As such for purposes of determining when an I5 or R5 adjustment of status application may be filed, USCIS is listing this category as “Unavailable” for October. If there is legislative action extending this category for FY-2017, USCIS will update this chart and begin accepting and adjudicating I5 and R5 adjustment of status cases accordingly.
