  • June 28 - Supreme Court on Children of Unwed Fathers

Comment: Supreme Court on Children of Unwed Fathers
The Supreme Court has agreed to hear a case on the constitutionality of treating children of US citizens born on foreign soil differently based on whether their mother or father is a US citizen, in those cases when their parents are not married. The law currently requires unwed fathers who are US citizens to spend at least five years living in the United States before they can confer citizenship to a child born abroad, out of wedlock; whereas for unwed US citizen mothers in the same situation, the requirement is only one year. The plaintiffs have argued that differing treatment of mothers and fathers violated the Equal Protection Clause of the 14th Amendment to the US Constitution.
