    Comment: Changes in EB-5
    The SEC action against the Chicago RCs is not the last enforcement action in the EB5 area. Immigration Daily has learnt that the SEC is looking into various EB5-related Securities violations, of which there appear to be many. The SEC is not alone. USCIS has a major incentive in ensuring that the EB5 program works, and continues to produce jobs, as Congress intended it to do. To the extent that Securities violations jeopardize Regional Center operations, the job-creating mission of the EB5 program is in peril, something that USCIS does not want, and will take action to prevent. In this way, the enforcement efforts of these two very different agencies are united - SEC and USCIS will continue to work to change practices in the EB5 field to increase compliance with American law. The EB5 program at this juncture is quite different than the time when Matter of Izuumi brought the program to an almost complete halt about 15 years ago, a halt which lasted for the better part of a decade. Now that the program is on a sounder footing, we believe that USCIS will use the traditional tools of law enforcement to effect behavioral changes necessary to ensure that American law compliance receives more than just lip service throughout the EB5 field. We believe USCIS is getting ready to issue Notices of Intent to Revoke (NOIRs) to some Regional Centers within the coming few months, such NOIRs will likely be not just for inactivity, but will possibly include issues connected to Securities compliance. USCIS may well also increase reporting requirements by Regional Centers, in addition to enforcing existing reporting requirements. The EB5 field continues to move gradually in the direction of more direct investments, and away from pooled investments such as Regional Centers. For countries with a long history of entrepreunership, such as China and India, these direct investments may well be the way to go.     Focus: Physician Immigration For Experts
    Tuesday, March 26th is the deadline to sign up for Thursday, March 28th phone session of "Physician Immigration For Experts" with Robert Aronson, Lisa Claypool Stevenson, Greg Siskind, Kristen Harris, Joseph Curran, Jennifer Minear, and Rita Sostrin. The curriculum is as follows:

    FIRST Phone Session on March 28 - The Physician Workforce and Expected Immigration Reform Measures

    This should be a very interesting and timely session. While we are certainly making some interesting progress toward implementation of Comprehensive Immigration Reform, there is currently a very active and potentially successful initiative to create certain new measures intended to facilitate the immigration of foreign physicians. The whole purpose of this session is to lay forth these reform proposals so as to orient the immigration bar and other interested parties to certain changes that are currently under active discussion. So, this will be a very meaningful opportunity to set forth this reform agenda, to update stakeholders on the progress toward implementation, and to orient practitioners to possible changes that will impact their practices.

    SECOND Phone Session on April 18 - J-1 Waivers and H-1B Strategies

    While this session will address some issues on J-1 waiver strategy, it will focus mostly on H-1B considerations for physicians and, in particular, strategies for dealing with the H-1B cap. Strategies for H-1B exemptions and also the implications of the Hernandez-Schorr correspondence that creates a work-around, of sorts, to the H-1B cap will be discussed heavily.

    THIRD Phone Session on May 2 - Permanent Resident Options for Physicians

    This session will focus on employment-based strategies utilized by IMGs in attaining permanent resident status. Labor certification approaches will be touched upon, this session will focus mainly on non-PERM strategies used both by academic, as well as clinical physicians. Various EB1 options, NYSDOT approaches, as well as clinical National Interest Waiver cases, and Special Handling strategies will be reviewed. This session will focus on options for permanent residence that do not involve a test of the U.S. labor market.
