Comment: Prepare For China Retrogression -
Regional Centers and others raising EB-5 capital in China have to prepare for the likelihood that China EB-5 numbers will retrogress in FY 2013. For all practical purposes, this will put to a halt the raising of EB-5 funds from China until the EB-5 quota for China, once again, becomes current in October 2013. This halt for Chinese EB-5s could come as early as April 2013, according to the State Department's Visa Bulletin for December 2012. Furthermore, the Chinese EB-5 ecosystem is not accustomed to an interruption in the investor pipeline, and consequences similar to those that happened during EB-2 and EB-3 retrogression for India in the mid to late 1990s are to be expected - massive shock, and several years before the system adjusts to this new reality. Even after such adjustment has taken place, it is an open question as to the extent to which the Chinese EB-5 system will survive, since it is not just an immigration system, but is intertwined with the financial world (which may not be able to deal with retrogression given market realities), and furthermore the immigrants involved have options of convenience, such as third country passports, usually denied other immigrants due to the fact that these options cost in the six figures in US dollars.
