Department of Homeland Security has automatically extended the validity of Employment Authorization Documents (EADs) listed below issued with these expiration dates under the TPS designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua, and Sudan through January 4, 2021:

07/22/2017 11/02/2017
01/05/2018 01/22/2018
03/09/2018 06/24/2018
07/05/2018 11/02/2018
01/05/2019 04/02/2019
06/24/2019 07/22/2019
09/09/2019 01/02/2020
01/05/2020 03/24/2020

Additionally, DHS extended TPS designations for Yemen for 18 months through September 3, 2021.

In order to determine employees with EADs through TPS, one needs to find the code on the EAD. The codes for TPS are A12 and C19. If the EAD has that category and the country listed on the EAD is El Salvador, Haiti, Honduras, Nepal, Nicaragua, Sudan, or Yemen then the automatic extension is given to that employee. On the I-9, Section 3, one should note the appropriate extension.

I will keep you informed of any new developments. If you want to know more information on issues related to employer immigration compliance, I recommend you read The I-9 and E-Verify Handbook, a book I co-authored with Greg Siskind, and available at http://www.amazon.com/dp/0997083379.
