    Comment: EB5 OK With Unsecured Loans Please see below an article by Matt Gordon on the recent case Zhang v USCIS. USCIS has had a long practice of accepting loans as source of funds for EB-5, as long as the loan was lawfully sourced and secured by assets owned by the investor. Now the restriction of "secured" loan has been removed. In Zhang v USCIS the court ruled that plain language of the regulation means that unsecured loans from anyone, even unrelated third parties are acceptable for EB-5 purposes--dramatically expanding the use of loans in EB-5. Since the ruling was based on plain language, no Chevron deference was given. The plain language of the regulation binds USCIS as it binds anyone else. This ruling greatly expands the EB-5 market because many countries tax gifts but not loans. Relatives may also be more willing to loan money rather than gifting it, thus dramatically expanding the capital accessible to a prospective EB-5 investor. We expect that this ruling will dramatically expand EB-5 markets especially in countries like India.     January 14 - Simple and Certain

    Comment: Simple and Certain President Trump tweeted on Friday that “H1-B holders in the United States can rest assured that changes are soon coming which will bring both simplicity and certainty to your stay, including a potential path to citizenship. We want to encourage talented and highly skilled people to pursue career options in the U.S.” He is most likely referring to the proposed rule published by the DHS that proposes to make a change in the way in which H-1B lottery is run so that a slightly higher percentage of those with Masters degree win the lottery. Note that this rule affects only FUTURE H-1Bs and leaves hundreds of thousands of those currently on H-1B with no relief whatsoever. Those that hope this tweet has anything to do with the 100+ year backlog that Indian EB-3 applicants are deluded. There is a remote possibility that Mr.Trump might be referring to another draconian proposal that has been discussed in the Trump administration. This proposal would declare that H-1Bs are only valid for those with Masters degree from US universities and apply that to all current H-1Bs—thus declaring H-1Bs of those with Bachelors degree and those with Masters degree from foreign universities as invalid, and deporting hundreds of thousands of people. This would reduce the backlog for Masters degree holders from US universities by deporting the rest. So either the action hinted at in the tweet would have no effect on the backlog or it would mean deportation for most Indian H-1Bs. It is an impossibility that Trump administration has any desire, intention, let alone a proposal for helping H-1Bs stuck in interminably long green card backlogs. The actions and words of Trump administration officials with immigration responsibility demonstrate an anti-immigrant bias against all immigrants except those with white skin. This makes it futile to expect any meaningful immigration relief for Indian H-1Bs from the Trump administration, in fact the opposite should be expected. If anyone believes that Mr. Trump's tweet offers hope for Indian H-1Bs, we have a slightly used bridge in Brooklyn for sale dirt cheap, cash only. We encourage our readers to get the word out on the real meaning of Mr. Trump's tweet, Indian media and social media over the weekend have gone on desperation-fueled overdrive, so outreach by knowledgeable people such as Immigration Daily readers is necessary to combat Mr. Trump's fake news.
